SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 12 DECEMBER 2017
2.1 Council’s Delegations Register
In accordance with the LGA, Council has in place a Register of Delegations recording all
delegations made by the Council to the CEO, and the delegations which the CEO has on
delegated to various employees. The Register of Delegations must be made available to the
public for review upon request.
Pending adoption by Council, the updated Delegations of Authority (summarised in Table 1
below) and the reviewed Delegations of Authority not requiring any changes (except for updated
conditions) will be included into Council’s Delegations Register. The CEO will then on-delegate
various powers to relevant positions within the organisation to ensure operational efficiency.
2.2 2017/2018 Annual Delegations Review Process
The LGAQ provides Councils with a ‘Delegations Register Service’. This service outlines all
possible delegable powers within the list of local government related legislation in the following
two documents:
1. The Register of Delegations – Council to CEO; and
2. The Register of Delegations – CEO to Employee or Contractor.
The LGAQ engages King & Company Solicitors to provide assurance that its Delegation
Registers are up to date and can be relied upon by local governments. The LGAQ undertakes
comprehensive reviews of its Delegations Register each year. Updates to the LGAQ register may
result from:
1. Changes to relevant State legislation; or
2. Improvements to the register as identified by King and Company Solicitors.
The LGAQ provides that it is unlikely that all of the powers identified in its Delegation Registers
will be applicable to any one Council, and it is up to each particular Council to decide the powers
that are relevant to its operations and are required to be delegated. In not delegating a particular
power of a local government, Council alone (not the CEO) may exercise the power in the event
that it is required to be exercised by the organisation.
The Governance Team recently completed the prescribed annual review of delegations for the
2017/2018 period. The review process is outlined in the diagram below.
LGAQ via King and Company makes updates to its Delegation Registers.
Governance Team reviews LGAQ updates and determines in consultation with relevant operational teams ,
Directors and CEO whether the update is required and apprioriate timing.
Where changes to the register are appropriate for Noosa Council, a new Delegation of Authority or an updated
Delegation of Authority is prepared, which outlines the relevant powers to be delegated, and is reported to
Council for approval.
Once the delegation is approved by Council, the CEO where relevant and appropriate will on delegate the authority to
exercise that power to various positions within the organisation.
