RE: Application Reference: 51983.3225.14
Unit 9-10/30 Hastings Street, NOOSA HEADS, 4567, Lot 30 on SP307674
Additional Objection by Kris Chapman, Owner
Unit 24, The Hastings, 30 Hastings Street, Noosa Heads, 4567, Queensland.
In addition to my previous objection, I would like to make the following further comments:
Noosa Plan 2021 PO9 – Preservation of amenity including privacy, views, access to sunlight & green space
The proposed development dominates the landscape with little regard for its location within a Community
Titles Scheme (CTS). In such a scheme, whilst individual lot owners have certain rights and usage, the
property exists alongside multiple other owners. Purchasing into a CTS does not afford an owner the right to
build without due regard to the overarching scheme.
Located centrally on the western side of the complex, the increased building height and footprint of this
proposal significantly impacts multiple properties throughout the complex particularly in relation to
preservation of privacy, noise, natural light, shading and loss of green space.
I am particularly concerned re the change of use from the original two-level beach house construction with
enclosed roofing and one single small balcony to an amalgamated two-lot, four-storey construction with
several balconies and an open air, outdoor roof top deck together with kitchen and hot tub facilities,
compromises privacy and creates both overlooking and noise issues throughout the complex.
Being located between the hard concrete constructions at Bay Village shopping complex on the western side
and Sebel Apartments to the east means all sound emitted from the rooftop and balconies will bounce and
travel throughout the complex, generating additional acoustic disturbances that will potentially lead to
significant breaches of Community Titles Scheme By-Laws in relation to noise - refer Attachment 1: CTS By-
laws 30 April 2020.
Clearly the design of this development actively encourages and promotes the use of outdoor spaces which
takes advantage of Noosa’s magnificent climate. Were this development in a more open and residential
location e.g. Witta Circle, Noosa Parade, Cooran Court, Noosa Waters etc, this would likely have minimal
impact on adjacent properties and would be an entirely appropriate construction in keeping with a
residential zone. However, being located within a holiday, short stay, resort style Community Titles Scheme,
co-located in close proximity with other short stay holiday properties, it is not.
A Community Titles Scheme by definition means that one has bought into a complex that by its nature
requires all owners to be considerate of the surrounds and balance the rights and benefits of individuals with
the Scheme. Whilst properties along Noosa Parade and Hastings Street may have many of these elements in
common, the proposed development is not located in these situations. Its immediate environs are the co-
located properties within the complex overall, all sharing common property, central driveway and other
shared resources.
