| refer to our ongoing without prejudice meetings in relation to the above site and the Planning and
Environment Court (hereafter “Court’) Judgment (No 314 of 2008) dated 2 August 2010 for the
abovementioned development. In accordance with Section 368 of the Sustainable Planning Act 2009
(SPA), please find enclosed a pre-response request from Council to facilitate a request to the Court for a
Permissible Change to the Development Permit Material Change of Use to establish a Resource — Based
Spring Water Bottling Plant (Council ref: 2006/268) in accordance with section 269 (i) (d) of SPA. A copy
of the Court Judgement is included as Attachment I. This request is made on behalf of the owner of the
subject premises, Noosa Beverages Pty Ltd.

Please find enclosed the following in support of this request for a Pre-Request Response:

« A Pre-Request to Response Application form, duly completed;

¢ — Traffic Impact Assessment prepared by RoadPro Development (Attachment I);

e On-site Wastewater Treatment and Effluent Disposal prepared by Future-plus
Environmental (Attachment Ill); and,

¢ Acheque made payable to the Noosa Council for the $1,686.00, being the relevant fee.

BACKGROUND
This request seeks support of a change to the conditions of approval on the basis that the operations of
the premises are significantly less than what was originally sought and approved. The distribution of
Cooroy Mountain Spring Water products will now predominately occur from the recently approved
Wimmer's Factory at Lake Macdonald (MCU13/0171) with bottling and storage to continue from the
subject site, Whilst some minor distribution will occur from Cooroy Mountain Spring Water Factory, this
will be on an as required basis only.

Further, the manufacturing of product from Cooroy Mountain Spring Water will now be limited to bottled
water only, with office water coolers no longer manufactured and distributed. As such, the operations will
result in the following changes:
