Hi

Please see signed attached consent form. Unfortunately ants have moved into our scanner so a photo for now is the best I can do.

Happy to provide any information as needed.

Best wishes

Kevin

	Hi Terry

Kevin here again re. 268 Kinmond Creek Road. We now have the plans re. our proposed BAL-FZ build (attached). We would like to proceed with the application as we previously discussed on the phone.

In addition to the reasons given below there is an exisiting track to the proposed new site, although this would need a new crossover to connect to Kinmond Creek Road. The current track enters Kinmond Creek Road over the adjoining block (<10m) so we need to formally amend this. The current track goes all the way across our block to the neighbours property and we have already started to regenerate this area. The entire old track beyond the current build site will be planted out- this is much longer than the section we will retain. I can provide a sketch of this if it helps.

I attach the build plans and the bushfire report but would like to talk the application through with you. Is Friday afternoon convenient?

	Best wishes

		Hi Terry

Jason kindly forwarded me your email below. We would like to proceed with the application but it would be good to discuss by phone first. I am keen to understand a few details so that we can do this the most efficient way possible.

Our justification for placing the proposed dwelling where we have (or near to where is currently marked) is because this area is the least biodiverse area on the entire block and is accessed by an existing track. The area 10m setback from the front boundary is a vine forest that has no existing access and has for example 16 individual species of native vine. Our placement has been chosen based on clearing the least amount of vegetation and least impact on biodiversity. Our goal is to clear as little as possible to accomodate the house and meet the bushfire regulations. We will not clear more than the minimum required to meet BAL-FZ.

Please give me a call at your earliest convenience.

		Best regards

			Hi Jason,

I can confirm the trigger as advised by Council is correct. In reading their advice I would anticipate that they are also going to have an issue with the proposed location. Is there any justification (over and above your Client’s obvious preference for privacy) that may assist in gaining approval in the location as proposed for example are their site attributes that would preclude the house from being located 10m setback from the front boundary? I expect that in the absence of sufficient justification Council will not support the house in the current location. We have two options in this regard, lodge as is and expect an information request to re-locate (i.e. have a shot at the current proposal), or amend the plans now. It is entirely your Client’s preference.

My fee to prepare and lodge the application is $1,750+GST, I can have this done for you next week. If you would like to proceed please confirm the full names of all owner’s and I will get consent underway.

			Kind regards,

			Good afternoon,

The location of the dwelling will necessitate removal of vegetation in the biodiversity overlay area. You will be required to submit a Material Change of use application for the dwelling. The appropriate form is attached and the fee is $2242. Please submit the bushfire report with the application. You can email your application to [email protected] <mailto:[email protected]>

With the application, I would suggest that you provide justification around locating the dwelling so far into the site, which result in additional clearing of vegetation for access. If there is no reasoning, I would suggest you locate the dwelling closer to the front boundary, noting the setback requirements is 10 metres from the front boundary. Additionally, if there are other structures to be located on the site, eg. a shed, please indicate the location as well, so this can be considered as part of the application. This is because any building works requiring vegetation removal triggers an application.

			Kind regards

			Lisa

			Hi Kerri,

			Thanks for taking my call.

See attached building plans with proposed site plan and bushfire report.

The bushfire rating is BAL FZ at the moment we would like to try reduce this to BAL40 to make the project feasible for the owners.

Northcoast Enviromental Services have suggested we contact you to find out the rules around clearing this land due to the overlays on the block.

We would like to understand if there is an application we can make to gain permission to clear some of the vegetation to make this possible.

			We keenly await your reply.
