MCU14/0039 - further requests to address noise and stormwater concerns
Subject: MCU14/0039 - further requests to address noise and stormwater concerns From: Jack Lewis <[email protected]> Date: Thu, 19 Jun 2014 01:24:11 +0000 To: "[email protected]" <[email protected]> #ECMBody From: Terry Steer Sent: Wednesday, 18 June 2014 5:26 PM To: Nadine Gorton Cc: Jack Lewis Subject: RE: 305 Lake Macdonald Drive Cooroy Hi Nadine Further to my phone call today and our on-site visit yesterday, I confirm that the following site issues need to be addressed further: Generator Shed - suggested immediate and additional noise treatments: * Acoustic sealing of all gaps and cracks in the structure where noise would likely be emitted e.g. around exits of exhaust stacks, gap between floor and ply screening, fitting of appropriate insulated door, gaps in wall corners etc * Redirecting exhaust stacks away from residential areas and reflective surfaces that would direct noise towards the residential areas of Lake MacDonald Drive * Investigate the use of small, quiet portable generators (or similar) for operation of critical control equipment at night time etc and the turning off of large generators where possible * Advice from an acoustic consultant on permanent solutions so that noise emissions during night time hours do not cause a noise nuisance. Please be advised that noise produced by the generators that can be clearly heard at an affected premises between 7pm to 7am - on a business day or Saturday ; 7pm to 8am - on any other day, may constitute a noise offence under the Environmental Protection Act 1994. On-the-spot penalties apply. Sediment Control * Immediate installation of sediment control measures including: * Sediment/silt fencing at stormwater entry points to waterways * Stabilisation of exposed areas to reduce sediment runoff e.g. re-vegetation, turf, covering of loose soil to prevent stormwater carry of, diversion of stormwater from disturbed areas etc * Stormwater reuse options etc Please be advised that sediment runoff from the site to the creeks etc may constitute a release of contaminants to waters and result in an on-the-spot fine under the Environmental Protection Act 1994. Please advise on progress you have made to rectify the above and future actions and time frames for completion. It would be appreciated if you could advise in writing by cob Friday 20 June 2014. The enclosure of the generator with the timber panelling and insulation was one of many options discussed ( e.g. relocation of generators; turning off generators; concrete enclosure of generators; mains supply power etc) with Mr Ben Smider as a temporary noise reduction measure. This measure is only until such time as advice can be sought from a qualified acoustic consultant, regarding eliminating the intrusive noise permanently. The feedback Council has received from requestors is that there has been a reduction in noise levels over the weekend, however the noise emission are still causing sleep disturbance and noticeable intrusion during the day. A preliminary noise measurement undertaken on Friday afternoon, indicated an approximate reduction of around 6dB(A) at the property boundary. More work is urgently needed to eliminate the noise so that it is not detectable at residential areas. Please update Council on actions taken to permanently eliminate the noise emissions from the site including key timeframes.
