Mr Patrick Murphy,
The Assessment Officer,
Noosa Shire Council

Dear Mr Murphy,
Objection to the Scanlon Group Development Application
215-219 David Low Way, Peregian Beach
MCU 16/0153 & REC16/0041
I object to the proposed Development Application on the following grounds:
1) Material Change of use Application contravenes the Noosa Town Plan & will destroy our
point of difference & the attraction of our village to holiday makers & shoppers. The
Caravan Park amenity that was the real essence of Peregian village, will be replaced by
urban density with scarce landscaping.
2) No Compliance with Noosa Council requirements with majority of the accommodation
proposed for Permanent Housing. Priced from $725,000 to $850,000, this proposal will not
provide low cost accommodation for the growing needs of the local community. Peregian
Beach is already surrounded by new small lot housing developments that lack public
amenity, open space & village lifestyle.
3) Setbacks in general & to the Rufous laneway in particular, impinge on Noosa’s Master
Plan for Rufous St renewal which is currently in progress, community amenity values & the
extensive community consultation process intended to activate the Bush to Beach pathway
upgrade & encourage increased usage.
4) The Development’s impact on the creek & wetland, both during construction & upon
completion is of great concern, as is the planned density of housing in this ecologically
sensitive reserve & adjacent National Park. Some 25,000 cubic metres of imported fill will
be required, giving rise to 150 trips per day for at least 3 months. This means one heavy
vehicle axle load every 3-4 minutes along David Low way, down Sandpiper Lane, through the
IGA carpark & then back out via the Heron St roundabout.
5) Significant continuous Noise & Disruption to homes along David Low Way, adjoining
streets, PB Hotel, Hardware store, business & private premises in the vicinity of the
roadways & roundabout guaranteed.
6) Substantially Increased Traffic & Congestion is assured during construction as standing
traffic queues currently form at all accesses to the roundabout, particularly at daily peak
times, exacerbated further during school & public holidays. The proposed development risks
being a serious source of additional congestion & given the layout/landform, nigh on
impossible to mitigate in the future.

7) Long-term increased traffic on bin collection days, due to the inability of the rubbish
trucks to turn around within the development. Once a circuit of the development is
undertaken, the trucks will need to exit & utilise the roundabout on David Low Way to then
return & go the opposite direction to collect bins on the opposite side of the road.
8) The traffic management plan for the development seems to under-estimate the potential
number of vehicles that would be exiting the development. As the units on the eastern side
of the proposed development have self-contained “flats”, those 10 additional residences
have been left out of the calculations. Those flats could be rented out as “Studios” and
consequently have additional implications for traffic movements.
9) The Conference Room in the Hotel/Motel has no independent parking allocated. The
development application suggests that the Conference Room would only be used by people
residing within the Hotel/Motel complex. I don’t believe that intent would last very long into
the future. I envisage the room being available for lease to a variety of groups, which would
have unsatisfactory implications re parking by attendees.
10) The development application does not provide sufficient number car parks for
employees in the Hotel/Motel [at least 15 people (full-time and part-time)] There is also the
issue of where contractors would park (eg. cleaners privately engaged). Those without
carparks would then potentially park in the IGA carpark area, resulting in increased
congestion & traffic problems. This would push the problem elsewhere, in the Village that is
already suffering from limited parking.
11) Diminished vistas across the National Park to Mt Cooroy due to bulky Hotel/Motel
building’s projected heights. The views west from the IGA carpark will be significantly
diminished when the 3-storey hotel/motel is constructed. Council needs to ensure height
specifications are accurate & the current expansive views are maintained. Here’s an
opportunity to protect & showcase the intent of Noosa’s logo ‘Different by nature!’
12) The proposed development is not consistent with the reasonable expectations of
residents, given the Peregian Beach Caravan site is zoned to primarily provide for budget
visitor accommodation. The Open Space Recreation zone in Peregian Beach specifically seeks to
protect and retain the site for low cost visitor accommodation needs reflective of the site’s previous
use as a caravan park, but also acknowledges that a range of visitor accommodation may be
provided where integrated with budget accommodation. There is no support given to permanent
residents on the site.
13) Other concerns include density of buildings & infrastructure within the precinct, the
provision of scarce green space/vegetation/shade, preferred orientation to sunlight &
natural breezes, the provision of public access pathway between two story buildings, with
little to recommend passive surveillance or a non threatening environment, particularly at
night.
14) So many missed opportunities to work with community in consultation with Noosa
Council’s Master Plan for Rufous St & the adjoining laneway to add to the amenity. The
north western corner’s existing vegetation could have seen the creation of green
space/parkland to embellish the precinct for visitors & local community with potential to
make connections between Rufous St /laneway with this development instead it separates
itself from the village feel.

15) This proposal conflicts with community values, endorsed by all who reside & those who
choose this relaxed pedestrian location, where thongs, even bare feet are the norm. It
delivers instead, undesirable urban density & city lifestyle that’s aesthetically at odds with
Peregian’s much sought after relaxed village character & community engagement.
16) I am also concerned that there are implications for the neighbouring properties in
relation to potential future noise complaints. The adjoining Kindergarten has a wonderful
history of play-based activity, many of which occur outdoors. This can often be boisterous
and noisy. Future owners of properties along the northern boundary may not be willing to
take the noise-abatement steps proposed by the developers – specifically keeping the
windows/doors closed & air conditioners running if affected. (A similar situation applies for
the hotel drive-through.) The proposed development means the existing fence will not
abate any noise, which wasn’t an issue with the land when it was a caravan park. I fear that
future complaints may have negative implications on the operation of the Kindy’s programs.
17) Perusal of the latest version of the DA shows that the applicant did not tick the box
(Item 7) indicating that there is a watercourse in the site. There is a watercourse on the site
and this is plainly misleading. Noosa Council must clarify why the applicant did not indicate
the true situation and cannot grant approval for the DA until this question has been
answered and the implications of the fact that there is a watercourse have been fully
resolved. The DA covers a site that abuts directly onto a Noosa National Parks National Park
and this is a serious issue.
I urge Noosa Council to protect the village of Peregian Beach & to refuse this DA.
Signed,
Robyn Woodall
