REPORT
This report is intended to enable Council to endorse a new planning scheme (New Noosa Plan) for
the purpose of a first state interest review by the Queensland government.
The proposed New Noosa Plan remains confidential until it has been reviewed by the Queensland
government, is endorsed by Council for community consultation and is subsequently published.
Therefore, it is not publicly available as an attachment to this report.
1 Preparing the New Noosa Plan
The process to prepare a New Noosa Plan commenced with preparation of a Discussion Paper
that expressed numerous policy ideas addressing seven themes and also the localities in Noosa
Shire. The Discussion Paper was released for community feedback between October and
December 2016 resulting in approximately 500 suggestions.
In September 2016, Council decided to prepare a New Noosa Plan under the Sustainable Planning
Act and staff progressed with drafting. With the introduction of the Planning Act in mid-2017 and,
after guidance material was published by the government, Council considered the option of
continuing the scheme preparation process under the new legislation and subsequently resolved in
November 2017 to continue preparation under the new Planning Act.

SPECIAL MEETING AGENDA 29 MAY 2018
Preparing the New Noosa Plan took into account a large range of inputs, including:
The current Noosa Plan 2006 as a basis ;
Queensland government interests as expressed in the State Planning Policy 2017 and the
South East Queensland Regional Plan 2017;
The Planning Act 2016 and the Planning Regulation 2017 ;
Minister’s Guidelines and Rules 2017;
Queensland government guidance material;
Community feedback on the Discussion Paper;
Feedback from a Professional Advisory Group and a Business Advisory Group;
Feedback from a Social Forum and an Environment Forum;
Council’s endorsed plans, strategies and principles –
o Social Strategy
o Local Economic Plan
o Noosa Design Principles
o Sustainability Principles
o Noosa Transport Strategy.
Additional studies, including –
o Agriculture;
o Biodiversity including riparian areas;
o Centres Hierarchy;
o Extractive Resources;
o Natural hazards including flood management;
o Housing Needs Assessment ;
o On-site Effluent Disposal.
During preparation regular contact was made with officers of the Department of State
Development, Manufacturing, Infrastructure and Planning (formerly the Department of Local
Government, Infrastructure and Planning).
The proposed New Noosa Plan has been prepared in an online Tech One module called Eplan
which will offer significant improvements in functionality when the plan is released.
A new Local Government Infrastructure Plan will form part of the New Noosa Plan. It is currently
under preparation and will follow a different process to obtain government approval for
consultation. It will be submitted to Council for endorsement in coming months.
The steps to finalise the New Noosa Plan
The Queensland government was advised of Council’s decision to prepare the New Noosa Plan
under the Planning Act. As required by the Act the Chief Executive of the Department provided
Council with a Notice pursuant to Section 18 of the Act in March. That Notice sets out the
procedural steps and timeframes for making the New Noosa Plan.
Following Council’s endorsement of the proposed New Noosa Plan, it will be sent to the
Queensland government for the first state interest review. The Notice from the Chief Executive
indicates that this phase may take 45 business days but there is a prospect of a longer period if
either the government or Council choose to pause the process. The government will advise of any
changes it requires to be made to the proposed plan as a consequence of this review and these
will need to be incorporated. Following that review process the New Noosa Plan will be presented
to Council for endorsement for community engagement.

SPECIAL MEETING AGENDA 29 MAY 2018
In November 2017 Council endorsed a summary community engagement program for information
of the Queensland government. The summary was based on the engagement process undertaken
with the Discussion Paper and has now been expanded to form the full proposed engagement
strategy attached to this report. Staff propose Council endorse this strategy for submission to the
government with the proposed New Noosa Plan. However, in coming months Council will be given
the opportunity to decide if additional or different consultation measures should be undertaken.
After community engagement is completed, Council will consider submissions received and make
deliberations accordingly. The proposed New Noosa Plan will be amended to accommodate
Council’s responses to submissions and then sent to the Queensland government for a second
state interest review. Following that second review process and Council’s consideration to any
matters arising, Council will then be in a position to finally approve the New Noosa Plan. It is
currently anticipated this final approval step may take place by mid to late 2019.
Previous Council Consideration
In December 2015 Council considered a report that provided an overview of the timeline, resource
requirements, estimated budget and other considerations for undertaking a new planning scheme
project. As a consequence, budget provision has been made for preparing the new scheme and
assembling a project team.
Ordinary Meeting, 17 December 2015, Item 3, Page 7
That Council note the report by the Special Projects Officer and Director, Planning & Infrastructure
to the Planning & Organisation Committee Meeting dated 8 December 2015 and:
A. Note the draft project brief for the new planning scheme project; and
B. Authorise the CEO to make an application to the Minister for an extension of time to amend
Council’s Priority Infrastructure Plan in accordance with the Local Government and Other
Legislation Amendment Act (No. 2) 2015 amendments to the Sustainable Planning Act
(2009) (SPA) sections 997, 979, 983 and 996.
In September 2016, Council resolved to prepare a new planning scheme. The resolution was made
and acted upon pursuant to the Sustainable Planning Act 2009. However, with the introduction of
the Planning Act 2016, Council decided in November 2017 to discontinue preparation of the New
Noosa Plan under the Sustainable Planning Act and move to comply with the Planning Act.

That Council note the report by the Planning Scheme Project Manager to the Planning &
Environment Committee Meeting dated 7 November 2017 and:
A. Discontinue preparation of the new Planning Scheme under the Sustainable Planning Act
2009;
B. Propose to make a new Planning Scheme for the whole of Noosa Shire under the Planning

in principle and request that Chief Executive Officer provide a further report to the Council
regarding a detailed community consultation activities plan at the time the Council re-
considers the draft planning scheme following the first state interest review.
Finance & Risk
Council is likely to incur a cost of nearly $3 million in the preparation of the New Noosa Plan. The
risk of not having an appropriate plan setting out future land use and development forms is
unacceptable to Council and the community. This substantial expenditure is primarily associated
with undertaking extensive investigations to update key technical and background information that
directly feeds into the new plan and the engagement of additional project staff.
Consultation
External Consultation - Community & Stakeholder
The Department of State Development, Manufacturing, Infrastructure and Planning (formerly
Infrastructure, Local Government and Planning) has been regularly consulted about preparing the
New Noosa Plan.
Internal Consultation
A Project Working Group of staff was formed to give occasional feedback to the process. A
separate Working Group was formed to oversee the new local government infrastructure plan.
A significant number of workshops have been held (more than 30) with Councillors regarding all
key aspects of the Draft Noosa Plan over the past 16 months.

Project Description
A planning scheme is a plan prepared by local government that sets out the long term planning intent for the local
government area and regulates land use and development. It aims to provide certainty to the community about how the
local government area will develop in the future and over the life of the plan.
The Planning Act 2016 requires all Local Governments in Queensland to review a planning scheme every ten years and
decide whether to make a new planning scheme. The current planning scheme (The Noosa Plan) which came into effect in
2006 is now 12 years old and requires a comprehensive review. The New Noosa Plan will set out the strategic directions
for Noosa’s development to 2041.
The New Noosa Plan project has six stages as follows-
1. Prior preparation
2. Community consultation with a Discussion Paper
3. Drafting of New Noosa Plan
4. First State Interest Review
5. Community Consultation of draft plan
6. Second State Interest Review, Council adoption and commencement
1. Design - Project background
The new Noosa Plan is required under state legislation as set out in the Planning Act 2016. |n addition it is desirable to
re-engage the community about the future of development in Noosa as it is more than 12 years since Noosa Council has
undertaken that process.
Development of the New Noosa Plan is a significant project for Noosa Council and the Noosa community. It is a high
profile multi-year project, with long-term implications. It is anticipated the project will be finalised by late 2019. As well
as there being a statutory requirement to undertake consultation, there is an expectation by Council and the
community for community engagement during the preparation of the New Noosa Plan. Input from the community is
important to assist Council to develop a plan that appropriately captures the broad community’s values and their
preferences towards development and new opportunities.
The project includes community engagement at three stages of the project:
Stage 2 - Discussion Paper (consult)
Stage 5 - Draft Noosa Plan (consult)
Stage 6 — Council adoption and commencement of New Noosa Plan (inform)
The Discussion Paper stage was finalised in 2016. The Discussion Paper set out the key high-level policy approaches to
guide the preparation of the New Noosa Plan and was made public for community consultation in late 2016. Feedback on
the Discussion Paper was presented to Council in February 2017. Council resolved to consider the suggestions made by the

community in drafting the New Noosa Plan.
The New Noosa Plan is being prepared with involvement from the Queensland government and following endorsement of
the draft by Council and the government it will be made available to the public for consultation purposes. Public release of
the draft Noosa Plan is anticipated to commence in the last quarter of 2018. Although the minimum statutory period for
consultation is 40 business days, it is Council’s intention to undertake consultation for a period of 60 business days.
Adoption and commencement of the New Noosa Plan will be the final stage of the project and final engagement stage.
2. Design - Understand context & scope project
Context
Political
e It is desirable to commence and conclude the project within one term of Council. The next Council election will be
held in March 2020.
e Given the reach within the community and various interest groups, the Noosa Plan will be of considerable interest
and it is important to keep the community informed during the project.
e Changes to state legislation and state guidelines may impact on the New Noosa Plan project.
e State elections, have the potential to impact on the progress of the project due to ‘caretaker’ mode and/or change
of government. This will need to be taken into consideration as the project progresses and relevant information
provided through the engagement process. A state election was held in late 2017 and so there is limited prospect
of another election event in the remaining life of the project.
Economic
e The New Noosa Plan will take into consideration other strategies such as the Local Economic Plan and Centres
Hierarchy and has benefitted from input from key business representatives and groups.
e The various interest groups within the business community are key stakeholders and are expected to actively
participate in the principal community consultation stage.
e The New Noosa Plan will revise the zones and development standards for future business and industry land uses.
Social
e The New Noosa Plan will take into consideration other strategies and studies such as the Social Plan, Housing
Needs Assessment, and other relevant planning studies.
e The New Noosa Plan will address social issues such as housing choice, housing affordability, provisions for aged
care and opportunities for additional education and health facilities.
Technological
e New technology will be available for the legislated consultation requirements (T1 ePlan). This will be a different
format to previous engagement and will enable easier access across the various components of the plan.
Legal
e State legislation, including the Planning Act 2016, the Planning Regulation 2017, the State Planning Policy, the SEQ
Regional Plan 2017 and state-prepared guidelines govern the preparation of the New Noosa Plan.
Environmental
e Council is continuing to improve our knowledge of the environment and its processes. Council is undertaking a
Climate Change Adaptation Strategy and has undertaken further study of biodiversity and natural hazards. The
New Noosa Plan will be informed by the latest available information.
e Noosa Design Principles & Sustainability Principles will be referenced.
Historical
e Local heritage has been recognised in the current Noosa Plan 2006 and these measures will be again considered in
the New Noosa Plan.
Page 8 of 33Section 9

Page 9 of 33
SPECIAL MEETING AGENDA 29 MAY 2018
Community
e The Noosa community has a long history of activism aimed at protecting the values and character of Noosa.
Around 50 years ago the community began to monitor environmental management and forms of development.
The community’s participation in the preparation and review of the draft New Noosa Plan continues this
longstanding tradition.
Scope
Community engagement at this stage of the project (stage 5) will be designed to consult with the whole community to gain
feedback on the policy and content of the draft Noosa Plan. Activities already determined to be included are-
e The period of engagement being 4 weeks more than the required 40 business days,
e Pop-up stalls will be offered to the community in 8 locations throughout the Shire.
e A dedicated space in Tewantin has been chosen for displaying the New Noosa Plan with staff available to talk to
every day of the consultation period.
e Owners of property with significant change to entitlements will be directly advised.
e Briefings to particular stakeholder groups.
Additional engagement activities are nominated in Section 5 below.
Consultation on the New Noosa Plan will be supported by additional background information including Council and
Queensland government endorsed strategies, plans, policies and studies.
Stage 6 of the project will be focussed on informing community and stakeholders of the New Noosa Plan’s adoption and
commencement.
3. Design - Project Purpose
e The statutory obligations of the Planning Act 2016 and Minister’s Guidelines and Rules are met
e The community is engaged and actively takes part in the New Noosa Plan process
e Meaningful feedback is received from the community and stakeholders on the New Noosa Plan
e Asense of ownership/interest around the New Noosa Plan is held amongst the community
e The community is aware they are being heard by providing responses (and changes if appropriate) to
community feedback
e The community and stakeholders are informed of the New Noosa Plan’s commencement

Finance & Risk
Council needs to amend its current Priority Infrastructure Plan (PIP) to a Local Government
Infrastructure Plan (LGIP) by 30 June 2018 to continue issuing infrastructure charges and impose
conditions about trunk infrastructure on development.
Since January 2014 to April 2018, $9,880,023 has been collected in infrastructure charges
equating to a current average of $190,000 per month or $2,280,005 per annum. The 2017/2018
budget infrastructure charges revenue is estimated at $1,867,359.
A long term risk of LGIPs is the commitment ultimately made to provide future infrastructure at the
desired standards of service to meet development growth.
