RECOMMENDATION
That Council note the report by the Manager, Planning and Environment to the Planning &
Environment Committee Meeting dated 9 August 2016 regarding Planning & Environment Court
Appeal D88/16 and agree to defend the appeal.
REPORT
Background
In March 2014 a Material Change of Use (MCU14/0049) – Industrial Business Type 1 – Warehouse
(Self Storage Units) was lodged by Sharpe Enterprises Pty Ltd for On Guard Self Storage at 64-
66 Rene Street, Noosaville .The application sought approval for a Material Change of Use of
premises for an Industrial Business – Type 1 Warehouse for a self-storage facility to establish in
an existing building and within a proposed new building. The applicant also sought approval for
signage to the front of the buildings totalling approximately 24m2, (OPW14/0276) which exceeded
the as-of-right provisions of the Noosa Plan.
The matter was reported to Council in November 2014 wherein Council resolved to approve the
application in part for the self-storage facility but refuse the requested signage as the signage was
considered excessive and contrary to the Advertising Devices Code of The Noosa Plan. Council
also requested that the applicant remove all excess signage from the existing building and ensure
all signage complies with the acceptable solutions of the Advertising Devices Code. The
acceptable solutions of the Advertising Devices code requires that no single sign exceed 4m2 and
the total signage not exceed a combined sign face area of 10m2 for each premise.
In December 2014 the applicant lodged an appeal in the Planning and Environment Court against
Council’s refusal of the signage. In June 2015 Council agreed to settle the appeal with a
Development Permit for Operational Works issued and Condition 5 of the Development Permit for
Material Change of Use amended to read:
5. Signage on site shall not exceed the total signage area for each building as identified in the
Signage Schedules on Drawing OGSS-001-06 Revision P Elevations 1 & 2 and dated 24
May 2015 prepared by Steve McGregor Design Service.
The appeal was settled on the basis that the total combined signage for the existing building would
not exceed 12.53m2 and 9.23m2 for the new building given each building was considered a
premises and the site could be reasonably subdivided into 2 lots.
Attachment 1 refers to the approved signage plan.
