Following our conversation on Friday I have further reviewed the application at 6 Wyandra Street and additional information.



Council can only assess an application based off the information put in front of us, which at the time of assessment did show a development with a compliant plot ratio/development, which was approved subject to conditions. I don’t believe we can endorse the plan revisions outside of a planning process, the revised calculations are to be detailed in a minor change application and are to form part of the assessment.



I understand there are time constraints, the sooner it is lodged the sooner it can be assessed.



On submission of the change, please ensure all plans are dimensioned and scaled.

I am still of the view that a minor change application is required for the works, it’s retrospective works and exceeds the approved GFA.

  *   The final gross floor area calculation is shown in your screenshot as 242.5m2 which is contained within the delegated report?
  *   I am not quite sure where the screenshot GFA calculations are taken from, the GFA calculation method was not endorsed by the approval, the latest plan set which formed part of the approval was rev D.



Happy to discuss any sort of alternatives you see, I cannot put forward a solution to the matters as I will be assessing the application.

Can you please provide a practical solution for moving forward without a minor change application. Noting the reporting in the delegated report didn't give a final GFA calculation.

Furthermore, the approval does not have a specific condition pertaining to GFA and the approved plans condition reads:



Development undertaken in accordance with this approval must generally comply with the approved plans of development. The approved plans are listed in the following table unless otherwise amended by these conditions.

  *

Upon further detailed calculations of the GFA (attached and drawn both from scratch and included both laundries that were originally excluded, measured to OF of external walls and CL of party), the original approval was for 42.23% and the changes result in 42.18% (a reduction in GFA).



  *   Original Approval GFA calculation = Including U1 & U2 Laundries, but excluding U1 Powder Room: 252.7m2 or 42.23%

  *   Proposed GFA calculation = including U1 & U2 Laundries, and including U1 Powder Room + Garage Storage: 252.42m2 or 42.18%

There is also a case to be made for the area at the end of each stairwell landing area to not be included in the GFA calculation to reduce the areas further.



At the end of the day, these units are built, the site cover is below the maximum and we have reduced the GFA that was originally approved.

Please can you provide some practicality in allowing this to be considered generally in accordance for plan sealing purposes.

Thank you for your time on the phone on Friday. Following review of the revised plans I am of the view that a minor change application is required. Should the changes solely relate to reconfiguration of bedrooms within the approved upper and lower footprints the plans could have been endorsed through a generally in accordance process. As the revised plans show an increase of gross floor area, I don’t believe this can be endorsed through a GIA pathway. This is noting:

  *   Unit 1 – the submitted GFA calculations incorrectly exclude laundry, cupboard space.
  *   Unit 1 – through the assessment of the original application it was raised that development did not achieve the site’s plot ratio and that laundries/bathrooms where included. Subsequently the amenities were removed and were detailed to form part of the garage for parking of vehicles, bikes etc, and approved/conditioned accordingly. The area shown as “PDR” which is submitted to be decommissioned and used for parking of bikes is not an appropriate solution, for this space to be excluded from GFA it is to meet the exclusions as per the administrative term.
  *   Unit 2 - the submitted GFA calculations incorrectly exclude laundry, cupboard space, walkway
  *   Unit 2 – the addition of the void does not appear to offset the extension to the upper-level bedroom/ensuite.



I appreciate that Council’s software is not as accurate as the drafters/architects, welcome to send through a copy of the calculated areas, measurements etc. For reference, the below areas were captured in the assessment officers plot ratio calculations of the site at the time of approval.

Following inspection of the premises on 5/11/24 the following variations to the development permits were identified:

  *   Unit 1 contains a bathroom attached to the garage, the approved plans show this area as forming part of the garage. This was an amendment undertaken by the Applicant during the application process to reduce the development’s plot ratio. This will require a change application, as the development now exceeds the site’s maximum plot ratio as prescribed by the Performance Outcome, alternatively structural changes will be required.



Structural changes are being made to this area to ensure this area complies with The Noosa Plan Definitions and is not Gross Floor Area.

Changes were made to the layout as a result of the sale of the property, changes in construction methods and costs (i.e. smaller pools and more landscaping). However, no significant changes to layout and/or building overhangs affecting site cover or GFA.

  *   The development does not comply with Conditions 2 & 13 of the Material Change of Use. The approved plans and condition require screening along the eastern elevation of the balcony.

Condition 13 is outlined below and a picture is provided  with fixed external screens installed to obstruct direct veiws from the balcony overlooking the neighbouring windows (4.5m to boundary).What has been installed on site appears to be a 20 x 40 RHS batten with 40mm gaps. We can provide planters on the balcony to further screen if necessary?
