Attention: Mark Lewis, Coordinator Engineering
Dear Mark,
Development Application for Operational Works for a Dwelling house at 320 David Low
Way, Peregian Beach, described as Lot 219 on P93111
Reference is made to the Referral Agency Response for the proposed dwelling at 320 David
Low Way, which was issued on 21 November 2022 (RAP22/0012). Further to our recent
discussions about the need for a fenced hoarding area to be erected within the road reserve,
fronting the site to allow for the construction of the dwelling.
The application is being lodged in compliance with condition 14, with respect to the
construction of the driveway for the parking and manoeuvring areas on the site. Attached is
the engineering design prepared by Westera, which is consistent with the approved plan under
condition 14 (refer Attachment 1).
This application is being lodged concurrently with representations made to condition 13 of
the current approval (RAP22/0012) to allow for removal of street trees within the hoarding
area.
Driveways and Parking Code
With respect to the proposed access, the most relevant code under the Noosa Plan 2020 is the
Driveways and Parking Code. The most relevant performance outcomes are addressed below:
PO1
Vehicular access does not adversely impact on safety, capacity and operations of the existing or
planned road network, cycleways or pedestrian pathway systems.

Comment:
The proposed access will not adversely impact on the safety and operation of David Low Way
and the pedestrian footpath fronting the proposed dwelling. Access and egress to the dwelling
is to be in a forward gear. The applicant provided Traffic Engineering Advice prepared by Hayes
Traffic Engineering dated 17 August 2022, which has been accepted.
PO2
Driveways and crossovers:
a) are suitable and safe for their intended use; and
b) match Council infrastructure.
Comment:
The design of the access for the dwelling has been undertaken by Westera (RPEQ) and is
consistent with the approved plan, this being the Civil Works Plan, Drawing No. S21-110-C02,
Revision D, dated 22 August 2022. The driveway is suitable and safe for the intended use and
has been designed to match the existing concrete pathway fronting the site.
PO3
The number of driveways across pedestrian footpaths is minimised.
Comment:
A single access is being proposed for the dwelling minimising the impact on the pedestrian
footpath.
PO4
Vehicular access does not adversely impact on the capacity, operations, and maintenance of the
existing infrastructure.
Comment:
The proposed access driveway will not adversely impact on the capacity and operation of David
Low Way and would benefit from clear sightlines.
PO5
Vehicular access does not adversely impact on the health and integrity of existing landscaping
or native vegetation, where possible.
Comment:
The applicant has been diligently progressing with the detailed design of the dwelling, which
has taken some time, primarily because of the difficulties associated with developing this
significantly constrained site. This has impacted on the manner in which the dwelling can be
constructed and also meant the cost of construction needs to be carefully considered. The
construction phase for the dwelling will require a hoarding area to be established within the
road reserve fronting the property, which has been discussed previously.

The construction of the dwelling will need to occur in accordance with the Construction
Management Plan (Attachment 2). The building materials and equipment, including a
concrete pumping truck, will need to be placed within the road reserve to the east of the
concrete footpath during construction. There is no other location near the site for this purpose,
with the hoarding area fenced off but allowing for pedestrian access along the existing
footpath as shown, with traffic management to be provided.
Because of the nature of David Low Way being a major collector road, there is no ability to
park within this roadway in this location. Further, access to and within the existing service road
to the north is limited and also removed from the site. There is an existing power pole also
blocking access from the neighbouring driveway, with the use of this driveway not being
desirable in any event. To be frank, there is no other area near the land to park construction
vehicles and materials to allow for the construction of the dwelling, which has been carefully
assessed by the applicant’s builder and previously acknowledged by Council.
The hoarding area necessitates the removal of some street trees within the road reserve as
shown on the Civil Works Plan (Attachment 1). Once construction is completed, it is intended
to reinstate the street trees and landscape the footpath area close to the dwelling as shown
on the attached Proposed Road Reserve Rehabilitation Plan (Attachment 3).
It should be noted that the majority of the trees within this location were shown to be removed
on the approved Civil Works Plan under condition 14 to improve sightlines (RAP22/0012). An
additional street tree is to be removed as shown in green to the south of the proposed
driveway (refer Attachment 1).
It is also noted that the advice provided by Hayes Traffic Engineering at the time of approval
recommends the removal of long grass and overgrown vegetation within the verge to improve
sightlines for the access1. The access to the site will effectively be left in and left out because
of the driveway location on this roadway and would benefit from improved sightlines.
In accordance with condition 16 of the approval, the applicant has obtained a Geotechnical
Investigation Report from tectonic geotechnical and environmental engineers (refer
Attachment 4).
In summary, the design of the driveway is consistent with the approval for the dwelling granted
by the Council. There is a need to provide a fenced hoarding area on the road reserve for the
construction of the dwelling as provided in the CMP. The trees within the road reserve are to
be replaced and the area landscaped in accordance with the LCP.
