OBJECTION –MCU15/0029
18 Duke Street Sunshine Beach

Dear Sir/Madam
We are the Body Corporate Managers for Mykonos Noosa CTS 4610 located at 37 Duke Street Sunshine Beach. The Committee has requested that we lodge a submission in regard to the application for a proposed Restaurant to be established at 18 Duke Street.
Mykonos is located across the road from 18 Duke Street and Owners are concerned that this proposed change from an office to a restaurant will affect the peaceful enjoyment of their property. Reasons given are as follows:

· Noise
Currently there is a fair degree of noise in the street due to the location of a backpacker hostel in close proximity. The addition of a Restaurant to this precinct will increase the noise levels especially at night. This will increase if the proposed restaurant obtains a liquor licence and permission for live entertainment.

· Existing Entertainment Precinct
Given that there is already a significant Restaurant presence further along Duke Street the Owners can see no reason for the addition of a further Restaurant in what is a predominately either residential or holiday accommodation. It is the opinion of the Owners that any additional restaurants should be restricted to the existing area.

· Car Parking
Car parking is already at a premium especially during holiday periods. It is a regular occurrence that illegally parked vehicle block the driveways to Mykonos and Owners believe that this will increase markedly if the proposed Restaurant is approved.

· Litter
A problem already exists where alcohol and soft drink bottles are left on the front fence of Mykonos at night, in some cases the bottles have been smashed on the footpath and wall leaving the residents to clean up to avoid injury to passing pedestrians and young children residing in the property. It is felt that no matter how well run the proposed Restaurant is there will be an increase in this unacceptable behaviour.

· Street Appeal
The area is currently a mix of permanent or holiday accommodation with the only exceptions being the existing backpacker hostel and a small 4 lot office complex at 18 Duke Street. The backpacker hostel is bounded by a high fence and the office block has extensive landscaping in the front of the property. It is expected that the proposed Restaurant will seek to have outdoor dining as part of the approval conditions. Owners do not consider this appropriate for a Residential area.

· Ambiance
Sunshine Beach has a village appearance and atmosphere and Owners believe that a Restaurant away from the existing Restaurant precinct will adversely affect the ambiance of the area and will affect the property values of all residents.

In summary the Owners of Mykonos have unanimously requested that the Body Corporate lodge a strenuous objection to this proposal.

Regards
