PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 6 JULY 2021 The original subdivision approval (RAL17/0511) addressed the flood hazard overlay on the site at the time the lots were created. The original application included a flood model outlining flood levels across the site and was required to ensure that the proposed lots will have adequate levels of flood immunity and safe access. The flood modelling was reviewed by an external Hydrology and Water Management Consultant. The original planning report for the subdivision application states: ‘…the issues of flood impact on the proposed development has been suitably addressed by the applicant and Council’s hydraulic consultant. The application demonstrates and provides for sufficient area, being 1000 square metres, that is available for development on each lot.’ 8. SITE DETAILS Site & Locality Description Road Frontage 32m frontage to Church Street Existing Significant Vegetation The site is free of vegetation Topography The site slopes from the south eastern corner of the lot down to the north western boundary Surrounding Land Uses The site is surrounded by a mix of low density residential and medium density residential zoned land. The predominant existing development in proximity to the site is single dwelling houses. The Pomona Local Centre is located approximately 140m to the east of the subject site. 9. ASSESSMENT The applicable planning scheme for this application is Noosa Plan 2020. The following planning scheme codes are applicable to this application: Low Density Residential Zone; and Low Density Housing Code The application has been assessed against the above codes and has been found to be compliant with, or can be conditioned to comply with, the relevant provisions of the codes. The pertinent matters arising out of the assessment are outlined and discussed below. Low Density Housing Code Acceptable Outcome AO21 of the Low Density House Code states: Filling other than accessways: (a) does not extend more than the equivalent of 3 metres around the main building, measured from the outer walls of the building; (b) is limited to a maximum of 500m2; and (c) does not impact on the local drainage of adjoining properties. The proposal is to extend up to 7m from the outer walls of the building, and as such does not comply with AO21. Corresponding Performance Outcome PO21 states: Earthworks and drainage operational works do not directly, indirectly or cumulatively cause adverse impacts external to the development site by: (a) causing ponding of water on the site or nearby land; (b) increasing flooding, which adversely affects the safety or use of any land upstream and downstream; (c) adversely affecting the flow of water in any overland flow path; and (d) adversely affecting the privacy or visual amenity of surrounding property.
