1. PROPERTY Real Property Description: Lot 5 on RP202304 Area: 2,000m? Zone: Low Density Residential Overlays: Nil South East Queensland Regional Plan: Urban Footprint 2. SITE DESCRIPTION The subject property is located on the south-eastern side of Pearsons Road, approximately 40 metres north-east of Caruthers Court at Cooroy; the property has a frontage 28.82 metres to Pearsons Road. A single storey brick house stands towards the road frontage of the property. A pool is located centrally on the property. The property is connected to the water, sewerage, power, telephone and inter-allotment drainage services. Water, power and telephone services are located along the Lake Pearsons Road frontage; sewer reticulation is located along the southern boundary with two house connection branches available, and inter-allotment drainage is located at the north- eastern corner of the property with existing Easement rights to the point of discharge. The drainage from the house drains to the kerb along the Pearsons Road frontage Pearsons Road is a well-formed bitumen road with kerb and channel in place; and a concrete footpath has been constructed across the frontage. The existing vehicular access to the property is located at the south-western corner. The western part of the land is flat and the rear part of the property slopes down to the east at approximately 3%. A Smartmap of the locality is contained in Appendix A showing the adjoining development and local precinct. 3. Source: NSC Mapping 4. PROPOSAL It is intended to subdivide the subject land to create 2 residential lots as shown on the attached Plan of Proposed Reconfiguration attached as Appendix B (Ref: 12-3313AE). Lot 21 containing the dwelling comprises 1039m? will have direct frontage to Pearsons Road; and Lot 22 is a rear allotment comprising 961m? with access to Pearsons Road via a 4.5 metre wide Easement for Access & Services. The proposed subdivision will require the de-commissioning of the pool and the removal of all internal water and electricity services that traverse the new boundary. It is intended that fencing remains around the de-commissioned pool. The proposed Reconfiguration will require the completion of Operational Works: including construction of the driveway access to Lot 22; and installation of power reticulation, telecommunication reticulation and water to the lots. 5. STATUTORY ASSESSMENT - STATE GOVERNMENT 5.1 State Planning Regulatory Provisions The site is included within the SEQ Regional Plan State Planning Regulatory Provisions — Land Use Category of Urban Footprint; the proposal is a permitted development within the Land Use Category. Therefore no further assessment is required.
Page 5
5.2 Referral and State Development Assessment Provisions The site is not contained within the SARA Mapping of Matters of Interest; therefore it is considered that the application does not require referral to SARA. 5.3 State Planning Policies The site is not mapped as being affected by any of the State Planning Policy's State interest 6. NOOSA PLAN 2020 The subject property is located with the Cooroy Local Plan Area and within the Low Density Residential Zone of the Noosa Plan 2020. The application requires code assessment against the following benchmarks: Cooroy Local Plan Code; Low Density Residential Zone Code; Reconfiguring a Lot Code; and Works Code. A discussion of the benchmarks is detailed below: 6.1 Cooroy Local Plan Code The proposed subdivision complies with all relevant provisions in the local area code. The proposal is located within the urban boundary and will create residential lots that meet community requirements. The proposal creates low density residential lots in an infill development that includes an efficient provision of existing infrastructure. 6.2 Low Density Residential Zone Code The development complies with the relevant provisions of the zone code. The proposal provides for an efficient pattern of land use and infrastructure. The development is an in-fill development that creates an additional walk-able estate with connections to the local school, parks and shops. 6.3 Reconfiguring a Lot Code The development complies with the relevant provisions of the Reconfiguring a Lot code. The subdivision creates lots that: are appropriate for their intended use, contribute to high standard of amenity; are consistent with the character of the local area; responsive to the site constraints; improves environmental values and avoids off-site environmental impacts; provide lawful, safe and practical access arrangements; have the long axis in an east-west orientation; and provide infrastructure and services to the lots. eoeceoeveoeee
Page 6
All proposed Lots contain an area and a frontage that comply with the prescribed minimums for Lots in the relevant zone. With respect to Performance Outcome 21; Lot 22 adjoins 5 lots. The Acceptable Outcome prescribes a maximum of 4 other Lots, which basically requires only 1 lot per side of a rectangular lot. Lot 22 adjoins 2 Lots along the southern boundary; which is a necessity to achieve access to the sewer reticulation and to minimise the length of the access handle. The proposed lot layout is consistent with the prevailing urban development pattern of the local area and is not detrimental to amenity upon the adjoining lots. 6.4 Works Code The reconfiguration complies with the Works Codes. A Development Application for Operational Works will be submitted for assessment following approval of the Reconfiguration of a Lot application. 7. CONCLUSIONS This Development Assessment Report has been prepared to accompany Development Application for Reconfiguring a Lot submitted on behalf of Garry Walker. The site is located within the Low Density Residential Zone and in the Cooroy Local Plan of the Noosa Plan 2020. The proposal comprises the subdivision of 1 Lot to create 2; and includes an Easement for Access and Services. The development complies with all relevant Performance Outcomes of the Codes in the Noosa Plan 2020. The subdivision is appropriate given that: All proposed residential Lots include an area of at least 600m?. The proposed development complies with the Overall Outcomes of the Cooroy Local Plan Code. « The proposed development complies with the Overall Outcomes of the Low Density Residential Zone Code. e The proposed development complies with the Overall Outcomes of the Reconfiguring a Lot Code. e The proposed development is consistent with the site’s designation of Urban Footprint in the South East Queensland Regional Plan. The development complies with the relevant parts of the State Planning Policy. The proposed development complies with the relevant parts of the State Development Assessment Provisions. Therefore, it is considered that the proposed development warrants approval from Council subject to the imposition of reasonable and relevant conditions. Max Watterson
