            action has threatened, is threatening or would threaten:-
                (a) to endanger the life, personal safety or health, or welfare
                    of the State’s population or part of it; or
                (b) to cause significant damage to the State’s economy or
                    an important part of it.
Chief       Power, as the employer, to apply to the registrar for a certificate Section 242(2)
Executive   stating that the employer need not negotiate with an employee Industrial Relations Act
Officer     organisation under chapter 4 because of a circumstance in 2016
            section 171(5).
Chief       Power, as a party to a certified agreement or a bargaining Section 250(3)
Executive   award, to sign the affidavit prepared pursuant to subsection (2) Industrial Relations Act
Officer     on behalf of Council.                                            2016

Chief       Power, as a relevant party subject to a direction of the Section 251(4)
Executive   commission, to comply with the direction on behalf of Council, Industrial Relations Act
