Chief       Power, as agency, to give a prescribed written notice to an Section 68(13)
Executive   applicant, for an access application, of:                       Information Privacy
Officer     (a)    the decision on the application, including a decision to Act 2009
            refuse to deal with the application; and
            the fact that the document is not a document in the possession,
            or under the control, of Council, if this is the case take all
            reasonable steps to facilitate entry by an authorised officer on
            the date and time consented to or stated under subsection
            68(2)(d).
            (b)    Note – this section does not commence operation until 1
            July 2026 (see section 219).

Chief       Power, as agency, to not include any exempt information or Section 68(3)
Executive   contrary to public interest information in the notice given under Information Privacy
Officer     section 68(1) Information Privacy Act.                            Act 2009
