DELEGATE DESCRIPTION OF POWER DELEGATED LEGISLATION ADOPTED BY CONDITIONS TO WHICH
COUNCIL THE DELEGATION IS
SUBJECT
Chief Power to end sale procedures at the earliest of the following: Section 141(3) Local
Executive (a) Council has been paid the amount of the overdue rates Government
Officer or charges, and all expenses that Council has incurred in Regulation 2012
attempting to sell the land; or
(b) the land has been sold; or
(c) 1 year after the notice of intention to sell was given to the
registered owner.

Chief Power to set a reserve price at the auction of the land for Section 143(1) Local
Executive overdue rates and charges in accordance with section 143(1). Government
Officer Regulation 2012
Chief Power, if the reserve price for the land is not reached at the Section 143(2) and (3)
Executive auction, to enter into negotiations with any bidder who attended Local Government
Officer the auction to sell the land by agreement (for a price not less Regulation 2012
than the reserve price).
Chief Power, after the day of the auction, to decide to continue to offer Section 144(1) Local
Executive the land for sale by another auction, or sale by negotiation. Government
