DELEGATE DESCRIPTION OF POWER DELEGATED LEGISLATION ADOPTED BY CONDITIONS TO WHICH
COUNCIL THE DELEGATION IS
SUBJECT
Chief Power, if the land is a building unit and it is not practicable to Section 144(6) Local
Executive display the sales notice in a conspicuous place on the land, to Government
Officer display the notice in a conspicuous part of the common property Regulation 2012
for the building units.
Chief Power to ensure that the price for land offered for sale by Section 144(7) Local
Executive negotiation is at least – Government
Officer (a) the market value of the land; or Regulation 2012
(b) the higher of the following –
(i) the amount of the overdue rates or charges on
the land;
(ii) the value of the land.
Chief Power, in the circumstances set out in subsection (1), to give the Section 145(2) Local
Executive registrar of titles an appropriate form. Government

Chief Power to use the proceeds of sale of the land for the purposes Section 146 Local
Executive and in the order specified. Government

Chief Power, where Council has by resolution decided to acquire the Section 149(2) Local
Executive land for overdue rates or charges, to give all interested parties a Government
