Please find attached herewith landscape plans to comply with Condition 9 of the above mentioned development approval.

Please note this is not an operational works application.

There is no trigger under the Planning Scheme to make landscape works, assessable operational works. Landscape works as operational works is not defined or identified under the table of development of the locality plan.

Part 6, Division 13, Table 6.11 advises that the following is code assessable:

‘Carrying out operational works associated with material change of use where Development Permit for material change of use has been issued.’

When defining operational works, Part 2, Administrative Terms refers to the repelled Integrated Planning Act 1997 (IPA). Landscape works is not list under the meaning of operational work under IPA (or SPA).
