EXECUTIVE SUMMARY
On 21 January 2014 Noosa Council endorsed a three step process to reshape the Noosa
Biosphere Reserve Management arrangements including the establishment of a working group,
consultation with key stakeholders, workshops and the calling of submissions from the
community.
Council adopted a proposed Noosa Biosphere Reserve Management Model at its meeting on 3
April 2014 for the purpose of undertaking further community consultation. Community
consultation was undertaken and the Noosa Biosphere Working Group reported back to Council
on the outcomes of that consultation and consequently recommended changes to the
management model.
A revised model was adopted by Council on 29 May 2014 and the Chief Executive Officer was
authorised to commence implementation and transition to the new model.
RECOMMENDATION
That Council note the report by the Executive Manager to the General Committee Meeting dated
17 November 2014 and authorise the Chief Executive Officer to progress and finalise the
necessary documentation to establish the Noosa Biosphere Reserve Trust, the Noosa Biosphere
Reserve Foundation Ltd and registration of the company.
REPORT
The new Noosa Biosphere Reserve Management model included the establishment of a trust for
charitable purposes (to be called the Noosa Biosphere Reserve Trust or similar) and the
establishment of a company as trustee of the Trust (to be called Noosa Biosphere Reserve
Foundation Ltd.)
To progress the establishment of the trust and company, legal advice was sought in the drafting
of the formal legal instruments and the process required for registration of the company.
Draft documents were prepared and advertised for public comment on 29 September 2014. The
formal submissions received were considered by the working party and as a result several
amendments to the draft documents were made.
To progress the establishment of the Noosa Biosphere Reserve Trust and Noosa Biosphere
Reserve Foundation Ltd it is requested that Council authorise the CEO to progress and finalise
the necessary documentation to establish the trust deed, company constitution and registration of
the company.
Once finalised, the Trust Deed and Company Constitution will be referred to Council for adoption.
This is aniticpated to be in the December round of meetings.
