Dear Sir/Madam,

RE:           MINOR CHANGE TO APPLICATION (MCU15/0095) UNDER S350 OF THE SUSTAINABLE PLANNING
              ACT 2009.
              COMBINED MATERIAL CHANGE OF USE APPLICATION FOR A SERVICE STATION AND SHOP AND
              THE RECONFIGURATION OF A LOT (1 INTO 2);
              115 EUMUNDI-NOOSA ROAD, NOOSAVILLE (LOT 30 ON SP170751)

Further to the above application, please find below our formal notice for a minor application change in
accordance with s351 and s352 of the Sustainable Planning Act (SPA) 2009.

In support of this written notice, please find attached the following documentation which comprises the
changed Reconfiguration of a Lot Plan.

The key changes include:

             Easement E is now to comprise part of proposed Lot 2 whereas the previous plan submitted
              showed Easement E as part of proposed Lot 1.
             This change does not result in lot sizes below the minimum lot size of 1000m2 for Industrial lots in
              the Noosaville Locality as per S1.1 of the Reconfiguring a Lot Code within the Noosa Plan.

In accordance with section 350 Meaning of minor change, the proposed change is considered to be minor
as the change-

      (i)         does not result in a substantially different development; and
      (ii)        does not require the application to be referred to any additional referral agencies; and
      (iii)       does not change the type of development approval sought; and
      (iv)        does not require impact assessment for any part of the changed application, if the original
                  application did not involve impact assessment.

Refer below for an assessment against s351 and s352 of SPA 2009:

351 Changing application

      -       The proposed change does not result in a not being a properly made application and does not
              result in a prohibited development. Further the proposed minor change does not include a change
              of applicant.
