GENERAL COMMITTEE MEETING AGENDA 13 DECEMBER 2021

Motorcycle/ Scooter Sales and Repair
The purpose of the Medium Impact Industry zone is to provide for medium impact industry and other
uses and activities that support industrial activities and do not compromise the future use of the area
for industry activities. The Motorcycle/Scooter Repair component of the proposed use is considered
a low impact industrial use, however the sales component of the business is considered retail rather
than industrial. The retail (sales) component of the business supports the function of the repairs
use and whilst not ancillary (subordinate) it does not compromise the future use of the premises of
industrial activities as it is intended to operate within the existing building and confines of the
premises and is complementary to the motorcycle/scooter repairs. The proposed
Motorcycle/Scooter Sales and Repairs use does not compromise the function and viability of
business centres within the Noosa Shire Hierarchy and is considered compatible with surrounding
uses and development.
As per Strategic Outcome 3.35 e) smart, innovative and sustainable businesses and industries,
which are a response to changing market conditions are supported. The motorcycle/scooter market
is a growing transport option within the Noosa Locality, which is also recognised within Strategic
Outcome 3.3.6 d), which provides for priority transport infrastructure for motor scooters and public
transport over private cars. The proposed use of the premises supports positive business outcomes
that are aligned with Noosa's Strategic Outcomes and represents new enterprises and new ways of
doing business.
The proposed use Motorcycle/Scooter Sales and Repair is therefore considered an appropriate
outcome for the site that supports the overall intent of the Noosa Plan and zone provisions.
Caretakers Accommodation
The proposal seeks to establish a Caretakers Accommodation at the rear of the premises to provide
24hr security and after-hours delivery purposes. The Caretakers Accommodation is 65m2 and is
proposed to be occupied by the business owner.
The proposal complies with the design requirements for the Caretakers Accommodation including,
acceptable level of residential amenity, remains ancillary to the non-residential activities on site, and
provides sufficient carparking and private open space. However, the application fails to demonstrate
that the proposed caretakers accommodation is genuinely needed on site as required by the
planning scheme codes. The applicable code requirements are provided below as follows:

Caretaker’s Accommodation, Dwelling Unit and Rural Worker’s Accommodation Code
     PO2
Caretaker’s accommodation is used for bona fide caretaking or property management
     purposes such that:

               1. in the Rural zone, caretaker’s accommodation is required because of the need to
caretake a non-residential activity on site; or
               2. in the Low Impact Industry zone, the Medium Impact Industry Zone
or the Innovation Zone, caretaker's accommodation demonstrates the need for
24 hour care of buildings, operations, plant or equipment.

Editor’s Note—Council would require sufficient justification that the caretaker’s
Accommodation is required for the industry, rural or other activity on the site.
The overall outcomes sought for the Medium impact industry zone are as follows: -
      (j) caretaker's accommodation:
      (i) occurs only where directly associated with an industry activity on site and there is a
          demonstrated operational need for full-time caretaking;
