Subject: RE: Bushfire Management - Noosa Civic
Importance: High

Hi Conor, Kim

Thank you for your email and prompt response. We consider this a critical issue in providing a primary line of defence for both property and personal safety in light of the recent, current and immediately forecast weather conditions.

We provide the following information in response to your queries:

1. Information regarding the reason for difference in the previous recommendations of the approved amended bushfire report. The September 2019 actions proposed differ from the previous advice provided by The Consultancy Bureau in June 2018 specifically Section 4 and in the Annual Review 2018-2019 Section 4 May 2019.

The 2018 advice provided by The Consultancy Bureau states in Section 4:

“The Fuel loads in Area 4 are 15 years old (last unplanned fire was in 2003) and up to 15 tonnes/ha. (see Photographs Nos. 9 & 10). It is not proposed for any development in this area in the foreseeable future as such some ongoing management is required to maintain a safe environment for the nearby Noosa Civic Development”

Section 6 then goes on to state that,

“…The surrounding lands to the south and east are out of the control of the subject site so the effective management of the vegetation of the development is essential. The risk may be high but infrequent because the local climate will ensure that in most year the hazard is in a wet, low threat condition. However, once every 10-15 years there is a likelihood of a high risk fire season (September to December). As such, an annual, preseason preparedness schedule should be part of the Centre’s management.”

Les has confirmed that the clearing along the southern boundary has not previously occurred as the land is often in a wet, low threat condition. However, given the current environmental conditions, and that it has been 16 years since the land last burned in 2003, immediate action is necessary. During the assessment in May 2019, the area was wet. We would be happy for Council (or their consultant) to directly engage with Les in this regard.

2. Date of proposed works require clarification.

Hall Contractors have been engaged and will provide supervision and machinery, and flora and fauna spotters. Stockwell has directly engaged the surveyor.

Works will take approximately 7-10 days to complete, commencing immediately following mobilisation.

3. Clarification of the Emergency Legislation referred to

We reference the letter from Mike Wassing, Deputy Commissioner for the Queensland Fire and Emergency Service. He refers to under broad ‘exempt clearing work’ provisions set out that for the purposes of bushfire mitigation, landholders are able to clear to establish and maintain:

- a fire break to protect infrastructure (other than a fence, road or vehicular track) up to 1.5 times the height of the tallest adjacent vegetation or 20m (whichever is wider)

- a fire management line of 10m width, and

- clearing to establish or maintain a fence up to 10m wide – providing a fire management line on the boundary of all properties.

Further, we refer to the Planning Regulation 2017, Schedule 21 Exempt Clearing Work. By definition, exempt clearing work means operational work that is the clearing of native vegetation—

(a)on prescribed land, if the clearing is—

(i)clearing, or for another activity or matter, stated in schedule 21 <https://aus01.safelinks.protection.outlook.com/?url=https%3A%2F%2Furldefense.com%2Fv3%2F__https%3A%2F%2Fwww.legislation.qld.gov.au%2Fview%2Fhtml%2Finforce%2Fcurrent%2Fsl-2017-0078*sch.21__%3BIw!WAYtP8DCH83FtDI!Hpuv0k9HixMTnJ1zwju3r24PJTq-3b8k5K0V6B4bOiAN3Cyb8-WevTkREuPO2k7VP0NH4_mZSxQ%24&data=02%7C01%7C[email protected]%7C56835ecf0db2412d6a7a08d73802e693%7C99d9dd67b90f4999a44ef2d3700133b2%7C0%7C0%7C637039459038962565&sdata=0ka5pa5FBH8TQENxLU4jA5Km%2Fsi4D4Z8xnsEonvy5jI%3D&reserved=0> , part 1 <https://aus01.safelinks.protection.outlook.com/?url=https%3A%2F%2Furldefense.com%2Fv3%2F__https%3A%2F%2Fwww.legislation.qld.gov.au%2Fview%2Fhtml%2Finforce%2Fcurrent%2Fsl-2017-0078*pt.1__%3BIw!WAYtP8DCH83FtDI!Hpuv0k9HixMTnJ1zwju3r24PJTq-3b8k5K0V6B4bOiAN3Cyb8-WevTkREuPO2k7VP0NHE4oAcVM%24&data=02%7C01%7C[email protected]%7C56835ecf0db2412d6a7a08d73802e693%7C99d9dd67b90f4999a44ef2d3700133b2%7C0%7C0%7C637039459038972552&sdata=1S%2FajOrwCOkoyhgdMiYXo9gq76g6IB9psj5yTuNnLv4%3D&reserved=0> ; or

As stated in Schedule 2, part 2c for freehold land, clearing vegetation that is necessary for essential management; where

essential management means clearing native vegetation—

(a)for establishing or maintaining a necessary firebreak to protect infrastructure, other than a fence, road or vehicular track, if the maximum width of the firebreak is equal to 1.5 times the height of the tallest vegetation next to the infrastructure, or 20m, whichever is the wider; or

(b)for establishing a necessary fire management line, if the maximum width of the clearing for the fire management line is 10m; or

(c)necessary to remove or reduce the imminent risk that the vegetation poses of serious personal injury or damage to infrastructure; or

(d)by fire under the Fire and Emergency Services Act to reduce hazardous fuel load; or

(e)necessary to maintain infrastructure (including core airport infrastructure, buildings, fences, helipads, roads, stockyards, vehicular tracks, watering facilities and constructed drains, other than contour banks), unless the clearing is for sourcing construction material; or…

4. Confirmation the proposed clearing of 20m along the southern section meets the exemption requirements for a fire break to protect infrastructure.

We refer above. The proposed clearing is the first line of protection for both the personal safety of employees and shoppers, along with infrastructure (ie building) of Noosa Civic and further development north and west from bushfire threats to the south.

5. Provision of the Aerial Photograph referred to in Section 3 of The Consultancy Bureau

The reference to the aerial photograph is incorrect – the included figure is the amended access management plan.

6. Confirmation an accurate survey of the Noosa Civic boundaries has been undertaken to ensure no encroachment into neighbouring lands.

We engaged Norris Clark & O’Brien Surveyors to conduct boundary confirmation survey this morning, along with identification of the boundaries of the proposed clearing along the extension of Hofmann Drive and the north south private road.

Clearing will be limited to 20m in width, to create a fire break. We will provide this confirmation to you as soon as received.

This will ensure no encroachment into neighbouring lands/adjoining areas.

7. Confirmation a spotter/catcher will be engaged to ensure the clearing works comply with the Nature Conservation Act 1992.

Hall Contracting, who we have engaged to undertake these works, has engaged Joel Keady from AW Environmental consultants. Joel is onsite today and will have a representative onsite for the duration of the works. We will provide their confirmation of assessment as soon as received.

8. Request for a Generally In Accordance letter regarding Development Permit for Noosa Civic (council file 132002.220285.8 (22803DA)) to endorse proposed change to approved Bushfire Management Plan and payment of associated assessment fee.

Of course, we are happy to finalise a revised Bushfire Management Plan and request for a Generally In Accordance letter for the existing approval (including payment of the associated GIA fee). We will commence preparation on this immediately.

Kind regards

Georgie

Subject: Bushfire Management - Noosa Civic

Hi Georgina,

Thanks for the follow up information regarding bushfire hazards at the undeveloped portion of the Noosa Civic, as attached. We understand this is a significant priority for you. I understand the recent fires in Peregian have highlighted the need to ensure adequate bushfire controls are in place in this fire season. Council is willing to work with you to provide a speedy response to your request.

Whilst this situation is a high priority, I require the following information to assist with the assessment of the request:

2. Date of proposed works require clarification.

3. Clarification of the Emergency Legislation referred to

4. Confirmation the proposed clearing of 20m along the southern section meets the exemption requirements for a fire break to protect infrastructure.

5. Provision of the Aerial Photograph referred to in Section 3 of The Consultancy Bureau

6. Confirmation an accurate survey of the Noosa Civic boundaries has been undertaken to ensure no encroachment into neighbouring lands.

7. Confirmation a spotter/catcher will be engaged to ensure the clearing works comply with the Nature Conservation Act 1992.

8. Request for a Generally In Accordance letter regarding Development Permit for Noosa Civic (council file 132002.220285.8 (22803DA)) to endorse proposed change to approved Bushfire Management Plan and payment of associated assessment fee.
