PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 25 MARCH 2014
Prior to the termination of the lease in 2011, Council’s annual lease revenue was in excess of
$90K p/a. SCRC went to public tender in early 2011 to award a new 10 year lease for an asphalt
batching plant. The successful tenderer, Fulton Hogan proposed to operate an asphalt batching
plant from the site, however, due to planning constraints under their development application, the
lessee advised that their ability to trade efficiently from the site was adversely impacted. The
lessee and SCRC mutually agreed to terminate the lease in September 2013 and the site is
currently vacant.
Council may not support further use of the site as an asphalt batching plant (or similar uses) as
these uses may not be acceptable for environmental reasons and the negative impact on the
local community. Given that these uses are not desirable it is proposed to test the market via an
EOI’s to seek proposals for a new commercial lease on the site. All applicants must submit a
value for the lease of the site for their proposed use. Council may then call tenders (Council are
not bound to only tender to the submitted EOI entities). The Local Government Regulation 2012,
Section 228 states that a Council resolution is required to invite Expressions of Interest.
It is proposed that an EOI Panel will assess the prospective offers utilising the following criteria:
1. Suitability of the proposed use at the site;
2. Community benefit and fit;
3. Sustainability;
4. Nature of the project; and
5. Proposed lease revenue.
