This matter having on the 9" day of November 2000 come on for hearing by way of appeal
from the decision of the Respondent Council whereby the Respondent refused the
Appellant’s application for a development permit for a material change of use to facilitate
development for the purposes of multiple dwellings (4 units) and restaurant on the land
situated at 3 James Street and 269 Gympie Terrace, Noosaville and more particularly
described as lot 1 on RP 226878: and lot 2 on RP 703702, Parish of Weyba and upon
hearing Mr Rackemann of Counsel for the Appellant and Mr Trotter of Counsel for the
Respondent;

IT IS THIS DAY ORDERED THAT by consent the said appeal be allowed and the
application for a development permit for a material change of use be approved subject to
the annexed conditions marked “A”
