Terms & Conditions – Arkhefield - Electronic CAD and BIM Data
Pertains to the issue of electronic data including, but not limited to, the following formats: RVT, DWG, DXF, DWF, DGN, SHP, STP, IFC, gbXML, XML, GML, NWF, NWC, NWD, ASCII text files.
In accepting and utilising any drawings, or other data on any form of electronic media generated and provided by Arkhefield, you covenant and agree that all such drawings and data are instruments of service of Arkhefield, who shall be deemed the author of the
drawings and data and shall retain all common law, statutory law and other rights, including copyrights. You agree not to use these drawings and data, in whole or in part, for any purpose or project other than the project which was the original subject of these
drawings. You agree to waive all claims against Arkhefield resulting in any way from any unauthorised changes or reuse of the drawings and data for any other project by anyone other than Arkhefield. You acknowledge, if these drawings and data are not the subject of
an “issued for construction” set, that their use is to provide an understanding of design intent and should only be relied upon as such. In addition, you agree to indemnify Arkhefield against any damage, liability or cost, including legal fees and costs of defence, arising
from any changes made by anyone other than Arkhefield or from any reuse of the drawings and data without prior written consent of Arkhefield. Under no circumstances shall transfer of the drawings and other instruments of service on electronic media for use by you
be deemed a sale by Arkhefield and Arkhefield makes no warranties, either express or implied, of merchantability and fitness for any particular purpose.
