                    RP Description Lot 1 RP112348

               1. DETAILS
The proposal seeks an exemption for alterations and additions to an existing dwelling house
located on land described as Lot 1 RP112348 and addressed as 20 Woongar Street, Boreen Point.
The northern part of the site is mapped as a Moderate Land slide Hazard Area and the north
eastern part of the site is mapped as a High Land slide Hazard Area.

The Planning Act 2016 allows exemption certificates to be issued where ‘the effects of the
development would be minor or inconsequential, considering the circumstances under which the
development was categorised as assessable development’.
The development is eligible for an exemption certificate as:
The Low Density Housing Code includes an error in that an ‘or’ has been excluded between
Acceptable Outcome AO22.1 and AO22.2 and that a slope stability report would satisfy the
acceptable outcomes if the report demonstrates as low or very low risk.
The applicant has provided a Geotechnical Investigation Report from JK Geotechnics (Ref:
35891URrpt Rev1) concluding that the site is suitable for the proposed development and that the
development will not have a detrimental impact on the stability of the site on the condition that the
design and construction of the proposed development is completed in accordance with the
geotechnical advice presented in the report.
