ORDINARY MEETING AGENDA 15 JULY 2021
6. The proposed new building does not comply with Performance Outcome PO12(f) of the
Medium Density Residential Zone Code as the proposed front building setback is not
consistent with the predominant character of the surrounding area and does not allow
sufficient landscaping in the front to enhance the streetscape.
B. Note the report is provided in accordance with Section 63(5) of the Planning Act 2016.
REPORT
A report on this application was considered by the Planning and Environment Committee Meeting
on 6 July 2021 and was subsequently referred to the General Committee Meeting on 12 July 2021.
During the course of discussions at the General Committee Meeting, Councillors considered that
there may be grounds to support the proposal given the 3 previous development approvals for short
term accommodation in the coastal area. Councillors in discussion though, also recognised that
short term accommodation was impacting the housing supply for permanent residents.
In the circumstances, the General Committee requested staff prepare a further report for the
Ordinary meeting dated 15 July 2021 including conditions for approval of the application.
Staff have considered the issues raised by Councillors, but confirm the previous Officer
Recommendation. Should Council wish to approve the application, the requested motion below has
been drafted for that purpose.
Notably a condition has been included requiring that the building be setback a minimum of 6m from
the front boundary. Currently the proposal plans indicate a roofed terrace setback 4m from the front
boundary. This reduced setback is not consistent with the predominant character of the streetscape
and is contrary to the performance outcomes for the area.
