Erosion & Sediment Control - Works adjacent to High Ecological Significance
Water
91. Prior to the requesting the pre-start meeting the applicant must engage a Certified
Professional and Erosion Control to prepare and provide to Council scheduling plans for
the development which demonstrate that construction can be undertaken in a manner
consistent with Accepted best practice standards and all relevant conditions of this
approval. * (Refer to Advisory Note).
92. The applicant must engage a CPESC, or other suitably trained professional, (i.e. who
has completed the CPESC training, and has a minimum of 5 years site experience
supervising Erosion and Sediment Control management) to undertake weekly site visits
to inspect and certify whether or not required Erosion and Sediment controls are properly
installed and maintained to achieve the requirements on this approval.
93. Construction must be managed such that less than 2,500m2 of soil is exposed at any
time.
94. Exposed soil is only permitted between the months of May to October, and all
catchments with these soils must drain to sediment treatment features to achieve
50mg/L TSS prior to release of waters from the site. Outside these months the site must
achieve a C factor of 0.05 at all times.
95. A construction hold point with a council delegate and supervising RPEQ must be
established prior to commencement of cut to fill earthworks for each stage of the
development. The hold point must be held as soon as reasonably practical and prior to
the first rain event forecast following initial tree clearing or removal of soil stabilising
material for each stage. At the hold point inspection, all required sediment basins, drains
and bunds to divert waters away from disturbed soil or soils about to become exposed
through cut to fill activities must be installed. All areas that will not require earthworks in
the imminent cut to fill operation must be stabilised to prevent entrainment of sediments
into receiving waters.
96. Cut to fill earthworks must not commence until after the Supervising CPESC has certified
that all installed erosion and sediment controls required by this approval are sized in
accordance with conditions of the approval and the written acceptance of the certification
is provided to the supervising RPEQ by Council officers.
97. Prescribed Water Contaminants (as defined in Schedule 10 of Environmental Protection
Regulation 2019) must not be released from the site or to waters within the site, or be
likely to be released should rainfall occur, unless all reasonable and practicable
measures are taken to prevent or minimise the release and concentration of
contamination.
98. Sediment and erosion control measures must be in place prior to works commencing. If
such measures are not in place or are not satisfactory, “on the spot” fines may be issued.
Such fines can be issued if sediments from the site are found to enter or have the
potential to enter Council’s stormwater system, natural waterways, any downstream
stormwater filtration system or adversely impacting on other properties. The sediment
and erosion control design and measures have NOT been approved, it is the site's
Supervising Engineer who is responsible for ensuring that the sediment and erosion
control measures have:
a. Been duly designed by an RPEQ or CPESC and constructed in accordance with
"best practise" methods;
14
Section 17
b. Been revised by an RPEQ or CPESC to address the issues raised by changes in
the projected construction schedule and/or methods;
c. Been revised to address predicted rainfall events, and
d. Achieve the desired environmental outcomes.
99. Council may request further controls to be installed should the implemented measures
be found inefficient.
100. The erosion and sediment control measures must be designed, installed and maintained
in accordance with the supervising engineer instructions and the current best practice
standards * (Refer to Advisory Note).
101. The developer must ensure non-essential exposure of soil is prevented by restricting the
extent of disturbance and minimising the duration of soil exposure to adverse weather
conditions and effectively turf, cover or stabilise any disturbed area without delay and
prior to rainfall occurring.
102. The developer in conjunction with the engaged CPESC must ensure measures installed
to divert the upstream water are designed and certified by the supervising RPEQ and
installed prior to commencement of bulk earthworks.
103. The developer must ensure sediment does not leave the site or enter onto adjoining
properties or Council’s drainage system due to surface runoff or on tyres of vehicles
and/or machinery. It is essential to implement appropriate approved erosion and
sediment control measures throughout the site during all phases of construction
including vehicle shakedown pad/grid (or similar) at the access to the construction site.
Where sediments or other contaminants are deposited on a road, they must be removed
so as not to enter Council’s drainage system or waterways.
104. Prior to the completion of the development, all site surfaces must be effectively
stabilised. For the purpose of this condition, an effectively stabilised surface is defined
as one that does not, or is not likely to result in visible evidence of soil loss caused by
sheet, rill or gully erosion or lead to sedimentation, or lead to water contamination.
Water Sensitive Design
105. The active filter media of the bioretention device must be 27m². Active filter media area
is the area of the bioretention basin surface that is not covered by any impermeable
structure such as a sediment forebay, riser, etc.
106. During construction and establishment of the bioretention devices, the supervising
RPEQ must certify forms contained in section 3.15 of the Construction and
Establishment Guidelines: Swales, Bioretention Systems and Wetlands (Water by
Design, 2009). These forms and certification must be submitted to council prior to the
sealing of the survey plan.
107. A construction hold point with a council delegate must be established once the
bioretention device underdrainage pipe work is installed. At the time of inspection, a
sample of the drainage layer, transition layer, and filtration media materials must be
stockpiled onsite accompanied by laboratory results that demonstrate that the media
complies with the specifications contained in the latest version of the Guidelines for Soil
Filter Media in Bioretention Systems (Facility for Advancing Water Biofiltration) and that
the minimum hydraulic conductivity of 180mm/hr or as specified on the approved
engineering plans will be achieved. The drainage layer, transition layer, and filtration
media materials shall not be installed until the catchment draining to the bioretention
device has 80% groundcover as determined by council’s delegate.
108. Eighty percent (80%) of the catchment flowing to the bioretention basin must be
effectively stabilised prior to the construction holdpoint for the Bioretention device.
15
Section 18
109. Prior to the release of the plan of survey, the supervising RPEQ must certify must certify
