The following Recommendations from the Planning & Environment Committee were
adopted without discussion or further amendment.

1    PLANNING & ENVIRONMENT COURT APPEAL D88/16 FOR ENFORCEMENT NOTICE
     ISSUED TO SHARPE ENTERPRISES PTY LTD TTE (MCU14/0049, COM16/0040,
     OPW14/0276 & D88/16)
     That Council note the report by the Manager, Planning and Environment to the Planning &
     Environment Committee Meeting dated 9 August 2016 regarding Planning & Environment
     Court Appeal D88/16 and agree to defend the appeal.


2    PLANNING & ENVIRONMENT COURT APPEAL 3126/2015 FOR A REQUEST TO
     CHANGE CONDITIONS OF A DEVELOPMENT APPROVAL FOR A MIXED USE
     DEVELOPMENT AT 90 GOODCHAP STREET, NOOSAVILLE
     That Council note the report by the Manager, Planning & Environment to the Planning &
     Environment Committee Meeting dated 9 August 2016 regarding Planning & Environment
     Appeal 3126/2015 and authorise the Chief Executive Officer to finalise the appeal generally
     in accordance with the following:
     A.     Amend conditions 1, 10, 11, 12, 36:
            1.   Development undertaken in accordance with this approval must generally comply
                 with the approved plans of development. The approved plans are listed in the
                 following table unless otherwise amended by these conditions.
