Dear Sir/Madam
Information Request
Planning Act 2016
I refer to your application and advise that Council requires further information to satisfactorily assess the proposal.
application details
Application No.	132004.4029.01 & RAL22/0010
Street Address:	Avoca Lodge 1/6 Martin St Peregian Beach Qld 4573 Avoca Lodge 2/6 Martin St Peregian Beach Qld 4573
Real Property Description:	Lot 1 SP 215946 Lot 2 SP 215946 Lot 0 GTP 345
Planning Scheme:	Noosa Plan 2020 (25 September 2020)
INFORMATION REQUIRED
The information requested is set out below:
Issue – Site Cover & Plot Ratio
Acceptable outcome 10 of the Medium Density Residential Zone Code stipulates that site cover is not to exceed 40%, this is also reflected in the corresponding Performance outcome.
Acceptable outcome 11 stipulates that plot ratio of a development is not to exceed 0.4:1 which is also supported by the Performance outcome.
The proposed changes will have a site cover of 41%, and a plot ratio of 0.43. Both Acceptable outcomes are enforced by the respective Performance outcomes mirroring the site and plot ratio percentages. The Zone Code is specific in the maximum site cover and plot ratio provisions, variations of these provisions are not supported.
Information Required
Provide amended plans reflective of the Acceptable outcome and Performance outcome.
Issue – Plans
Eastern elevations have not been provided for the proposed deck extension to Unit 1.
Advice Required
Provide elevations inclusive of the proposed changes to Unit 1 to allow an assessment against the relevant overlooking and privacy provisions.
Issue – Garage Setback, and ‘Garage Roof Deck’
The proposed northern elevation shows the garage is to be built to boundary and achieve a height of 4.05 metres which will accommodate a deck above the garage. The proposed garage is single storey, 7.38 metres in length and is to accommodate an outdoor area with a pergola above the garage.
It is noted that the built to boundary garage will cause adverse amenity impacts and does not provide a high level of amenity to users of the adjoining premises. Further, the setback does not allow for landscaping between the building and northern property boundary. The proposal is not consistent with the predominant character of the streetscape. The proposed setback to the northern boundary does not comply with PO12 and is not supported by Council.
The proposed northern boundary setback does not comply for the garage or upper level, does not comply with Performance Outcome 12, and will not be supported by Council.
Advice Required
Provide amended plans showing a minimum the building setback of 1.5 metres from the northern property boundary, and demonstrate how the ‘Garage Roof Deck’ will not compromise the amenity and privacy of the occupants of the adjoining premises.
Reduce the overall height and dominance of the wall/fence. This may be achieved by providing soft landscaping, off-setting the fence and introducing landscaping.
Issue – Front Fence & Landscaping
The proposed front fencing is not designed and sited in accordance with Acceptable outcomes 17.1, 17.2 and 17.4 of the Medium Density Residential Zone Code.
The premises adjoining and surrounding the subject site typically are well landscaped and have low profile fencing (if any). A fence height of 1.8 metres for the full length of the property boundary in this locality and on a corner site does not comply with the corresponding Performance outcome.
Advice Required
Reduce the fence height and incorporate landscaping between the fence and front boundary setback reflective of the Acceptable and Performance outcomes.
Issue – Avocet Parade Driveway
There is insufficient information for Council to assess the proposed driveway and manoeuvring area in Avocet Parade.
Information Required
Provide an amended plan of the proposed access driveway and manoeuvring area. The amended plan must be prepared by a suitably qualified person (RPEQ – Registered Professional Engineer of Queensland) and include, but not be limited to:
a design that is generally in accordance with Council’s standard drawing RS-049, RS-050 and any associated addendum;
levels and grades of the access driveway;
a longitudinal section extending from the centre of Avocet Parade to the garage pad;
demonstrate that a B99 vehicle will not bottom out or scrape while entering/exiting the driveway; and
demonstrate the full extent of the transition to the adjoining areas of verge to eliminate the potential creation of trip hazards within the road reserve.
Please note that Council are unlikely to support privately owned retaining structures in the road reserve.
Issue – Martin Street Driveway
It is unclear from the submitted documentation what section of the existing driveway in Martin Street is to be removed and altered.
Information Required
Provide additional information demonstrating what section of the existing driveway in Martin Street is to be removed and details of the proposed altered works.
Issue – Stormwater
The proposed works indicate a significant increase in hardstand (impervious) areas. Council are concerned how this increase in hardstand areas will affect the subject site’s existing stormwater drainage conditions.
Information Required
Provide a preliminary Stormwater Management Plan that includes, but not limited to, details of how rainwater on landscaped and impervious areas will be collected and released from the site.
due date for response to information request
The due date for providing the requested information is 14 September 2022. Email your response to [email protected]. Please advise Council of your response to this information request in accordance with section 13 of the Development Assessment Rules.
If you do not provide a response before the due date, it will be taken as if you have decided not to respond to the information request and Council will continue with the assessment of your application.
