    EXECUTIVE SUMMARY
    Not applicable.

    RECOMMENDATION
That Council note the report by the Community Facilities Manager to the General Committee
meeting dated 15 March 2021 and
    A. Award tender T000031 to David Evans, trading as Poolside NAC; and
    B. Award the lease agreement for an initial term of two (2) years, commencing 1 April 2021
at a rate of $45,000 p.a. ex GST and increasing to $50,000 p.a. ex GST in year 2, with
an option to extend for a further three (3) periods of twelve (12) months each at a rate
of $55,000 p.a. ex GST in year 3 with CPI increases to be applicable in years 4 and 5, if
the options are executed. The options to extend will be at Council’s discretion and
subject to the Contractor’s demonstrated ability to meet the requirements of the lease
       agreement.

    REPORT
The operation of the Noosa Aquatic Centre (NAC) café has been contracted out to various
operators since 2009. The most recent lease holders elected to not seek activation of their
extension option and ceased their operations during the Centre’s Covid-19 closure in 2020.

Because of the operational uncertainty at the time, management deemed it was best to delay
approaching the market for a replacement operator until early 2021. Instead, an interim
management rights arrangement was agreed to with the café’s former manager.

    1. Tender Process

An invitation to tender for the operation of the NAC café was publicly advertised by Council
via Council’s website from the 4 February 2021 and in the Noosa Today print edition on the
11 February 2021. At tender box close on 25 February 2021, two (2) submissions were
received, one of which was non-conforming.

    2. Tender Assessment

The evaluation panel carried out an assessment of the one (1) conforming tender submission
from David James Evans, trading as Poolside NAC.
