Together, these changes require consequential amendments to the floor plans, site plans and
eastern elevation. Specifically, the proposal includes:
• reorientation of the balconies associated with Units 2, 3 and 4;
• reduction of each affected balcony from 9.92m2 to 9.22m2;

2. BACKGROUND
A development approval for Multiple Dwellings (5 Units) (MCU25/0136) was approved at 1 Olivine
Street, Cooroy (Lot 126 C5604) on 7 May 2026. The approval permits the construction and use of
five residential dwelling units on the site and is subject to a range of conditions intended to ensure
the development occurs and remains consistent with the assessment.
Condition 3 of the approval requires the development be undertaken generally in accordance with
the approved plans. The approved plans establish the development footprint and configuration of
the five-unit multiple dwelling development.
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
• South East Queensland Regional Plan;
• Planning Regulation 2017; and
• Noosa Plan 2020 (26 September 2025).
3.2. Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the
Planning Act 2016. An application for a minor change to a development approval can only be made
in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to
constitute a minor change on the grounds that:
• the development would not result in substantially different development as the proposal does
not:
o involve a new use; or
o result in the application applying to a new parcel of land; or
o dramatically change the built form in terms of scale, bulk and appearance; or
o change the ability of the proposed development to operate as intended; or
o remove a component that is integral to the operation of the development; or
• the change does not include prohibited development;
• the change would not require the application to be referred to an additional referral agency
or cause a referral agency to have regard to new matters prescribed by regulation;
• where the original application was code assessable, the change would not cause the
application to become impact assessable.
3.3. Statutory Instruments – Planning Scheme
The original application was lodged and assessed under the now superseded Noosa Plan 2020
(26 September 2020). Pursuant to s81 of the Planning Act 2017, Council must consider the
planning scheme in effect when the original development application was lodged, however Council
may give weight to Noosa Plan 2020 (26 September 2020) as the planning scheme in effect at the
time of the minor change application being lodged.
The following codes from Noosa Plan 2020 are applicable to this development:
• Medium Density Residential Zone Code;
• Cooroy Local Plan Code;
• Dual Occupancy and Multiple Dwelling Zone Code; and
• Works Codes;

Page 7
The proposed changes have been assessed against both the planning scheme in effect when the
original development application was lodged and the current planning scheme. The relevant
requirements for private open space, laneway access and waste storage screening remain
substantially unchanged. The assessment of each matter is set out below.
Private open space
The acceptable outcome for private open space in the Dual Occupancy and Multiple Dwelling Zone
Code is unchanged between the superseded and current planning schemes. For a small dwelling,
private open space is required at the following rate:
(a) at ground level, a minimum area of 20m2, directly accessible from the living spaces and
exclusive of the clothes-drying area; or
(b) above ground level, a minimum area of 9m2, with a minimum width of 2.5 metres and
direct access from the living spaces.
The proposed upper-level balconies for Units 2, 3 and 4 would be reduced from 9.92m2 to 9.22m2.
Each balcony would remain directly accessible from the associated living area and would exceed
the minimum 9m2 requirement. The proposed balcony changes therefore remain compliant and
are supported.
Olivine Lane Access
Performance Outcome PO17 of the Cooroy Local Plan Code under the superseded Noosa Plan
2020 corresponds with Performance Outcome PO18 under the current planning scheme. The
outcome requires development to facilitate the widening and upgrading of laneways in the Cooroy
Local Plan Area to accommodate anticipated traffic levels. In summary:
Development facilitates the widening and upgrading of laneways in the Cooroy Local Plan Area to
accommodate anticipated levels of traffic where:
(a) access to development is taken from a laneway, a 2 metre resumption from the
laneway frontage is required for widening and the laneway is upgraded to the
appropriate standard; or
(b) development is undertaken on a property with a laneway frontage and access is not
taken from the laneway, a 2 metre easement is provided for future widening and
upgrading purposes.
The revised plans show pedestrian stairs and a path connecting the development to Olivine Lane.
This arrangement would introduce access and permanent structures within the area required for
future widening and upgrading of the lane. It is therefore inconsistent with the relevant performance
outcome and is not supported. The approved plans should be annotated to remove the pedestrian
stairs and path to Olivine Lane.
Waste Storage Screening
Acceptable Outcome AO21.4 of the Medium Density Residential Zone Code under the superseded
Noosa Plan 2020 corresponds with Acceptable Outcome AO23.4 under the current planning
scheme. The requirement remains that waste storage areas, clothes-drying areas and external
storage areas are screened from the street.
The relocated waste storage area would be visible from Olivine Street. Screening is therefore
required to ensure compliance with the applicable acceptable outcome. The approved plans should
be annotated to require the waste storage area to be screened from the Olivine Street frontage.

Applicant’s Request
The applicant has requested that existing Condition 3 be amended to replace the relevant
approved plans with the updated Revision K plans dated 9 July 2026. The amendment is intended
to ensure the development is undertaken in accordance with the revised design, including the
reorientation and reduction in size of the balconies serving Units 2, 3 and 4, the consequential
changes to the site plans, floor plans and eastern elevation, the relocation of the waste storage
area to the rear of the internal driveway, and the revised pedestrian access arrangement to and
from Olivine Lane. The request also includes the addition of the Type Two Plans and Site Cover
Plan to the approved plans schedule so that the complete set of drawings accurately reflects the
proposed development layout and built form.
Assessment of Request
The proposed reorientation and reduction in area of the balconies serving Units 2, 3 and 4 would
not alter the approved use, dwelling yield, number of bedrooms, parking provision or overall scale
of the development. Each affected balcony would be reduced from 9.92m2 to 9.22m2 and would
remain directly accessible from the associated living area. As the revised area remains above the
minimum 9m2 requirement for above-ground private open space for a small dwelling, the balcony

Page 9
changes remain compliant with the Dual Occupancy and Multiple Dwelling Zone Code and are
supported.
The waste storage area is proposed to be relocated to the rear of the internal driveway adjacent to
Olivine Lane. The waste storage area would be visible from Olivine Street and must therefore be
appropriately screened from the street. Screening will be required by an annotation on the
approved plans to ensure the waste storage area is not visible from the Olivine Street frontage.
Subject to this annotation, the relocation of the waste storage area is supported.
The revised plans also show pedestrian stairs and a path connecting the development to Olivine
Lane at the southern end of the site. This component is not supported as Condition 18 requires a
2.0 metre-wide Public Thoroughfare easement across the full Olivine Lane frontage to remain free
of permanent structures, including footpaths and pedestrian stairs. The original approved plans
were also annotated by Council to state that stairs and a path onto Olivine Lane were not approved.
Retaining pedestrian access to the lane would therefore conflict with the existing approval and the
intended future widening and upgrading of Olivine Lane under the Cooroy Local Plan Code. The
revised plans should be annotated to remove the pedestrian stairs and path to Olivine Lane.
Subject to this annotation, and the screening of the relocated waste storage area, the amended
Revision K plans are supported for inclusion in Condition 3.
Recommendation
It is recommended existing condition 3 be amended to read as follows:
