Minor Change Report - MCU25 0136 01 (As Published)
The proposed changes have been assessed against both the planning scheme in effect when the
original development application was lodged and the current planning scheme. The relevant
requirements for private open space, laneway access and waste storage screening remain
substantially unchanged. The assessment of each matter is set out below.
Private open space
The acceptable outcome for private open space in the Dual Occupancy and Multiple Dwelling Zone
Code is unchanged between the superseded and current planning schemes. For a small dwelling,
private open space is required at the following rate:
(a) at ground level, a minimum area of 20m2, directly accessible from the living spaces and
exclusive of the clothes-drying area; or
(b) above ground level, a minimum area of 9m2, with a minimum width of 2.5 metres and
direct access from the living spaces.
The proposed upper-level balconies for Units 2, 3 and 4 would be reduced from 9.92m2 to 9.22m2.
Each balcony would remain directly accessible from the associated living area and would exceed
the minimum 9m2 requirement. The proposed balcony changes therefore remain compliant and
are supported.
Olivine Lane Access
Performance Outcome PO17 of the Cooroy Local Plan Code under the superseded Noosa Plan
2020 corresponds with Performance Outcome PO18 under the current planning scheme. The
outcome requires development to facilitate the widening and upgrading of laneways in the Cooroy
Local Plan Area to accommodate anticipated traffic levels. In summary:
Development facilitates the widening and upgrading of laneways in the Cooroy Local Plan Area to
accommodate anticipated levels of traffic where:
(a) access to development is taken from a laneway, a 2 metre resumption from the
laneway frontage is required for widening and the laneway is upgraded to the
appropriate standard; or
(b) development is undertaken on a property with a laneway frontage and access is not
taken from the laneway, a 2 metre easement is provided for future widening and
upgrading purposes.
The revised plans show pedestrian stairs and a path connecting the development to Olivine Lane.
This arrangement would introduce access and permanent structures within the area required for
future widening and upgrading of the lane. It is therefore inconsistent with the relevant performance
outcome and is not supported. The approved plans should be annotated to remove the pedestrian
stairs and path to Olivine Lane.
Waste Storage Screening
Acceptable Outcome AO21.4 of the Medium Density Residential Zone Code under the superseded
Noosa Plan 2020 corresponds with Acceptable Outcome AO23.4 under the current planning
scheme. The requirement remains that waste storage areas, clothes-drying areas and external
storage areas are screened from the street.
The relocated waste storage area would be visible from Olivine Street. Screening is therefore
required to ensure compliance with the applicable acceptable outcome. The approved plans should
be annotated to require the waste storage area to be screened from the Olivine Street frontage.
