2. Road works approval: Under section 33 of the Transport Infrastructure Act 1994, written
approval is required from the Department of Transport and Main Roads to carry out road works
on a state-controlled road. Please contact the Department of Transport and Main Roads’ on
[email protected] with the completed application form and supporting
information to make an application for road works approval. This approval must be obtained
prior to commencing any works on the state-controlled road reserve. The approval process
may require the approval of engineering designs of the proposed works, certified by a
Registered Professional Engineer of Queensland (RPEQ). Please contact the Department of
Transport and Main Roads’ as soon as possible to ensure that gaining approval does not delay
construction. Further information on applying for road works approval is available here:

Attachment 3—Reasons for referral agency response
(Given under section 56(7) of the Planning Act 2016)
The reasons for the department’s decision are:
The proposed development seeks to reconfigure an existing residential lot into two residential lots.
The existing dwelling is to be retained on the front lot, with a vacant lot created to the rear including
an access handle to Hill St, a state-controlled road.
Separate driveway access is proposed via Hill Street for each proposed lot, therefore an access
decision under s62A of the Transport Infrastructure Act 1994 is required.
The proposed development triggers assessment against State code 1: Development in a state-
controlled road environment of the SDAP.
The proposed access locations are suitably located so as not to adversely impact or cause safety
issues on the state-controlled road network.
The proposal achieves the requirements of State code 1, subject to conditions relating to minimum
design standard for construction of driveway access to each lot from the state-controlled road, and no
worsening of stormwater runoff onto the state-controlled road.
