MCU APPLICATION
JUSTIFICATION LETTER – 711 Louis Bazzo Drive, Cootharaba
SCOPE
A relocated dwelling is proposed at the above address.
The building work does not comply with the Noosa Plan 2020 ‘Rural Zone Code’ in the
following respect:
1. A road frontage setback of 6.161m to OMP and 6m to stairs is proposed in lieu of the
required 10m road frontage setback.
2. The proposed dwelling will not be located more than 200m from land on an adjacent
property included in the Rural zone and mapped as Agricultural Land Conservation
Area.
JUSTIFICATION
Road boundary setback-
Acceptable AO8.4
Outcomes In addition to the circumstances of AO8.1, to AO8.3 above,
buildings and structures meet the following minimum boundary
setbacks:
(c) 10 metres from a road frontage;
Performance Setbacks
Outcomes PO8
Notwithstanding that intensive rural activities may need greater
separation distances, buildings and other structures are
appropriately sited and designed to:
(a) avoid environmental harm or nuisance to sensitive land
uses, including adverse impacts on amenity values, over
and above what could reasonably be expected in the rural
zone;
(b) avoid adverse impact on ecologically important
areas including National Parks, watercourses, and
wetlands;
(c) mitigate risks associated with the use of chemicals or air
pollutants; and
(d) avoid conflict with rural uses and activities on adjoining
properties.

Proposed Outcome (a) The subject property is characterised by a very large road
reserve (approximately 23.5m in width) between the road
frontage boundary and the paved road (refer to Figure 1).
Furthermore, the road reserve is heavily treed which largely
shields the front of the property when viewed from the road
(refer to Figure 2 and 3). Consequently, the amenity
impacts of the proposal, as viewed from the road, will be
minimal.
In addition, the proposed location has been chosen
because it is an established level site which is the logical
house site, given that the vast majority of the rest of the
property is mapped as being potentially a Landslide Hazard
area (refer to Figure 4). Consequently, the proposed house
site will result in minimal earthworks which will in turn
minimise amenity impacts on the rural landscape.
(b) The proposed house site is well clear of any mapped
Biodiversity Overlay, Riparian Buffer Overlay and mapped
waterway and complies with the Planning Scheme in
relation to ecologically important areas, watercourses, and
wetlands.
(c) The adjoining properties to the north-west and south-east
are characterised by residential uses, and the house site is
approximately 180m away from the rear boundary of the
large rural zoned property to the north. Therefore there is
minimal risk of the use of chemicals or air pollutants from
farmland impacting on the house site.
(d) The house site is more than 160m from any rural zoned
property over 4 hectares in area mapped as ‘Agricultural
Land Conservation Area’ and so is highly unlikely to be
impacted upon by adjoining rural uses.
CONCLUSION Performance Outcomes are met.

in Agricultural Land Overlap Maps in schedule 2.
Performance PO2
Outcomes Development does not result in the loss or diminished productive
capacity of Agricultural Land Conservation Area.
Proposed Outcome The house site is more than 160m from any rural zoned property
over 4 hectares in area mapped as ‘Agricultural Land Conservation
Area’ and so is highly unlikely to be impacted upon by adjoining
rural uses.
Furthermore, there is ample space on the subject property for
future rural uses to be established, if this is desired by a future
property owner.
CONCLUSION Performance Outcomes are met.
