Figure 2 – Site Plan
background
A development approval for Operational Work (Roadworks and Stormwater Drainage) was approved on 9 January 2017.
The subject minor change application includes the requirement to remove trees and vegetation to install a footpath along Elm Street Cooroy QLD 4563 to allow foot traffic access to a bus stop. The works will require removal of approximately 47 native trees (no overlays over the area) which are therefore required to be rehabilitated within the same area to ensure the buffer remains and provides habitat. The applicant provided supporting documentation including an Arborist Report and a Landscaping plan. These are proposed to both be included as approved plans within the Decision Notice condition to ensure the correct trees are removed and replaced as detailed within the plans and report.
Council are proposing conditions with requirements prior to commencing works that ensure a pre-start meeting be completed and tree protection fencing be installed. These conditions will ensure that only the vegetation stipulated within the approved Arborist report are removed and all other vegetation is protected.
Conditions during construction are proposed by Council to ensure the following are completed as per the approved Arboricultural Assessment Report v1 and Landscape Plans version B:
Fauna management;
Retention of existing vegetation and trees;
Removal of existing trees and vegetation; and
Rehabilitation after vegetation clearing.
A condition for following construction is proposed by Council to ensure certification is provided for the landscaping works and NATSPEC to ensure the works have been completed as per the conditions and approved plans and report.
Relevant conditions have been included
assessment
Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017; and
The Noosa Plan 2020.
Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the Planning Act 2016. An application for a minor change to a development approval can only be made in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to constitute a minor change on the grounds that:
the development would not result in substantially different development as the approved;
the change does not include prohibited development;
the change would not require the application to be referred to an additional referral agency or cause a referral agency to have regard to new matters prescribed by regulation;
where the original application was code assessable, the change would not cause the application to become impact assessable.
Statutory Instruments – Planning Scheme
The following codes from the Noosa Plan 2020 are applicable to this development:
Works Codes.
