PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 OCTOBER 2016
5. CONCLUSION
Acres Noosa Garden and Lifestyle Centre has an existing approval for a retail garden centre and
café but has not been operating fully in accordance with the approval and seeks greater flexibility
for commercial tenancies. The “undefined” garden and lifestyle centre use is inconsistent with the
site’s residential zoning under The Noosa Plan but the development remains broadly consistent
with the intent of the existing approval for the site. The submitted table of uses for the
development’s tenancies will create a suitable control over the mix and intensity of uses.
Parking demand and residential amenity are the primary issues raised by the application. Traffic
assessment by the applicant’s and Council’s consulting engineers indicate on-site parking for the
centre will be sufficient, provided some conditions are applied.
Objections were received from adjoining residents indicating they have been experiencing fairly
constant levels of café patron noise. It is considered reasonable that residents’ amenity be
addressed by construction of an acoustic fence and further requirements be applied to manage
smoking, noise and spill light. It is also recommended that the development’s existing operating
hours are maintained and not extended.
The application is recommended for approval subject to conditions.
