sound system has provisions for this to occur through the system’s software. However, in
circumstances where patron noise alone causes exceedance of noise limits at the CEMLs, a
sound limiting device would be ineffective in reducing noise impacts, as it cannot control noise
generated by patrons.
The venue can also provide amplified entertainment using portable loudspeakers (provided by
booked entertainment) in the ground floor bar and first floor function room, as per the report
#1721d1-C. Any sound limiters installed in the permanent sound system would not operate for
portable loudspeakers as the systems are not linked and thus, any sound limiters installed within
the venue become ineffective in these cases.
Practical management of noise levels at the CEMLs should be included in the venue's noise
management plan, examples such as:
• Periodic checking and record keeping of noise levels at the CEML locations using a
sound level meter. This includes record keeping of any noise complaints received and
noise levels measured by venue staff/management at the time of the complaint.
• Taking proactive measures to reduce noise levels as required, such as:
o closure of doors/windows
o lowering output noise levels of amplified loudspeakers
o encouraging large or noisy groups of patrons to be mindful of the community
and/or dine indoors at times when noise limits are lower (such as after 10:00pm),
at the discretion of the venue manager/duty manager.
These example measures above do not require the use of sound limiting devices to be effective.
Section 5.2 of the venue's Risk Assessed Management Plan (RAMP) already ensures that
mitigation measures are put in place. A copy of the RAMP is provided in Appendix B. Should
operational and management controls be implemented, the venue can comply with the Liquor
Reg without the use of sound limiting devices.
With consideration of the above discussion, the use of sound limiting devices at the venue is
counter-intuitive to the application of the noise limit conditions endorsed by OLGR, in addition to
the configuration of the venue’s licensed areas and potential sound system configurations.
Therefore, it is recommended that all noise conditions related to sound limiting devices are
removed from relevant Noosa Council and OLGR noise conditions.
A detailed list of proposed replacement conditions for the Noosa Council Minor Change
Application, are provided below in Section 5.
