The Assessment Officer,

Att. Mr Patrick Murphy,
Submission re the Scanlon Group Development Application
215-219 David Low Way, Peregian Beach
MCU 16/0153 & REC16/0041
I am resident of Peregian Beach, having owned property in Peregian
for more than 20 years. I am an active member of our community
and wish to preserve the character of Peregian as recognised by the
Noosa Plan.
Noosa Council should uphold the Noosa Plan and not approve this
development application (DA) which is seriously and irreparably in
conflict with the Plan.
The site is zoned Open Space Recreation and there are no current
approvals for use as anything other than a caravan park. Hence the
Application can only be regarded as an egregious ambit claim.
What the developer is seeking to build is a high density complex of
26 multiple detached houses and a hotel with 20 visitor
accommodation units and 12 apartments for multiple and visitor
accommodation (i.e. permanent). It is completely at odds with the
real 'essence ' of Peregian and is not remotely contemplated for this
site under the Noosa Plan.
Conflict with Noosa Plan
The proposed development significantly conflicts with the Noosa
Plan, for the following reasons:
• The DA proposes building on Open Space Recreational zoned
land a development which is totally inconsistent in a multitude
of ways with the Noosa Plan;
• The DA raises significant environmental concerns especially
with regard to the watercourse and wetlands;
Page 3
• the proposed development is in serious conflict with multiple
requirements of the Eastern Beaches Locality Code:
• The proposed development is not consistent with the
reasonable expectations of residents in the locality, given the
Peregian Beach Caravan park site is to primarily provide for
budget visitor accommodation, which is in the public interest;
• There are no grounds provided that are sufficient to overcome
the level of conflict identified with the Noosa Plan.
With regard to the environmental disturbance , the Application fails
to acknowledge and provide protection for the significant wetland
habitat on which it is proposed to build or impact. The Application
has given no consideration for the Ground Parrot (Pezoporus
Wallicus - pictured below), the Wallum Rocket frog or the Wallum
sedge frog .
Even the developer's own experts (Adams and Sparkes)
acknowledge the conflict with the Noosa Plan in a multitude of
highly significant ways - and suggest no acceptable solutions .
I trust that this Application will be rejected by Council and not
taken as a point to start negotiations resulting in an unacceptable
compromise for the community and environment.
For all of the above reasons I urge Council to uphold the Noosa Plan
, protect this special place, and refuse this DA and the application to
reconfigure the 1 lot into 29 lots.
Yours Sincerely,
Susan Francis
