2/41-45 Duke St. Sunshine Beach Qld 4567 PB&J Smith 17 Jun 2015 Assessment Manager Noosa Council Tewantin Qld [email protected] Submission Re; Material Change of Use 2/18 Duke St. Sunshine Beach Qld Application No: MCU15/0029 Dear Sir; We wish to make the following submission regarding the above application; We are residents of the apartment building “Sunshine Vista” located directly opposite the above premises and feel the change of material use applied for will have a direct impact on the peaceful enjoyment of our property. LOCATION This location is well away from the existing late opening cafes/restaurants and bars in the lower section of Duke St. This end is Offices/Shops with one daytime Coffee Shop, surrounded by medium density residential. All of the residents in this area appreciate and expect a peaceful neighbourhood NOISE We note that the Acoustic Assessment provided to council by the applicant bases its findings on, Quote; “ Patrons speaking normally”,”People talking in a low noise environment”,“Patrons talking within the lower range of speech levels” Unquote. In reality these assumptions are flawed. Experience of previous functions and the Espresso Bar at this property has shown us that frequent loud talking and laughter is common, therefore the predicted noise levels in this assessment are understated. The premises in question are very small and rely on the alfresco area of the property and the street frontage to accommodate the majority of their patrons. Revellers in an alfresco environment, at night, are less inhibited than if contained indoors and therefore more prone to boisterous behaviour. This area of Duke St forms a hollow that contains and funnels noise around the area. The noise from patrons in the alfresco areas, particularly at night, can be clearly heard in the apartments of our building and surrounding properties.. The provision of high benches and stools and the lack of a kitchen and proper restaurant seating indicate that the premises will be used predominantly as a bar. It is well known that bar noise, particularly outdoors is considerably louder than Café noise. PARKING From early morning to late evening parking is at a premium in this area. Parking on nature strips and yellow lined areas is frequent. Changing the use of these premises from Office to Café will exacerbate this problem. In conclusion we believe the Material Change of Use would be detrimental to the peaceful enjoyment of the neighbourhood by a large number of local residents. The potential patrons of this proposed Café can be adequately catered to by the existing establishments at the lower end of Duke St. Regards; P.B.Smith Ph: 07 54735322 Mbl: 0408 718713 Email [email protected] [word/header1.xml] June 17, 2015 Page 2 [word/header2.xml] . . . . . . . . . . . . . . . . . .
