PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 14 OCTOBER 2014
RECOMMENDATION
That Council note the report by the Development Planner to the Planning & Organisation
Committee Meeting dated 14 October 2014 and
A. Approve the request to extend the relevant period for a further two years;
B. Change Condition 11 to read as follows:
11. The Development Permit for a material change of use lapses if the use has not
happened by 20 September 2016, unless an application to extend the currency is
approved by Council; and
C. Agree to execute the associated Infrastructure Agreement for contributions in lieu of one
on-site car parking space, prior to the issue of the Decision Notice.
REPORT
1. PROPOSAL
The applicant requests a further 2 year extension to the relevant period of an existing
Development Permit for Material Change of Use for a Professional Office (additions). The
applicant indicates that due to economic factors, the client has had difficulties in obtaining finance
for the proposal and requests an extension to the relevant period.
The application is before Council, as the original approval required the payment of a monetary
contribution in lieu of providing one off-street car parking space. The applicant has signed an
infrastructure agreement to pay $17,529 (as at June 2014) for one off-street car parking space.
2. SITE DETAILS
2.1. Background
On the 20 September 2006, Council issued a development approval for a commercial office
(additions). The approved development comprised an upper-level addition to an existing
commercial development (Tewantin Butcher) and included 5 small office tenancies with a
combined Gross Floor Area of 120m2. The development included rearranging the existing 15 bay
carpark, with access gained via Sidoni Lane at the rear of the site to accommodate a lift.
On the 7 April 2010, Council approved a 2 year extension to the relevant period, expiring on the
20 September 2012.
On the 12 June 2012, Council approved a further extension to the relevant period, expiring on the
20 September 2014.
A copy of the Locality Plan and Approved Plans are included as Attachment 1 & 2.
3. ASSESSMENT
In accordance with Section 388 (1) of the Sustainable Planning Act 2009, Council, when
considering a request to extend the relevant period, must only have regard to the consistency of
the approval, the current planning scheme & policies, concurrence agency views and the
community’s current awareness of the development.
The application was assessed under the Superseded Planning Scheme, and there were no
applicable concurrence referral agencies. An assessment against the current planning scheme
provisions is provided below.
