along the southern side (refer to Figure 9), in accordance with the Noosa Bushland Reserve
Strategic Fire Management Plan 2021 requirements. Approval was granted subject to conditions
on 8 June 2022, including the requirement to retain She-oak trees (Allocasuarina littoralis) in
perpetuity within this area. The fire access trail has recently been installed in accordance with the
approval. Refer to below assessment of the Bushfire Hazard Overlay Code for further details on
bushfire mitigation measures.

The area of the Girraween Nature Refuge utilised for fire access and fuel reduction purposes is
required to be maintained by the Residential Care Facility operator in perpetuity, or until the use
ceases, hence the requirement for an Infrastructure Agreement.
Council’s Environmental Operations Coordinator, Senior Environment Officer (Development
Assessment) and Engineering Coordinator (Development Assessment) were consulted in the
drafting of the Infrastructure Agreement to ensure requirements were established to ensure the fire
trail remains functional for firefighting purposes. These requirements were considered when
assessing the proposed stormwater works required to be carried out on Council land, the impact
construction activities would have on the longevity and functionality of the fire trail (from both a
firefighting and drainage perspective) and what rehabilitation/maintenance works would be
necessary post-construction. A subsequent Operational Works application will also be required to
be lodged for assessment, which will include a Maintenance Plan and Construction Management
Plan for the works, which will be conditioned to be complied with in any future Operational Works
approval, in accordance with the requirements of the Infrastructure Agreement.
4.    ASSESSMENT
4.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
•    State Planning Policy;
•    South East Queensland Regional Plan;
