Biodiversity Overlay Code, and further assessment is not required.
7.2.7 Natural Hazards Overlay Code
The subject site is identified as containing ’Flood Hazard Area’ and ’Subject to minimum
floor height’ within the Landslide & Flooding Overlay (refer to Figure 6.5) as well as
’Medium Bushfire Hazard Area’ and’ High -
Low Potential Acid Sulfate Areas’ within the
Bushfire & Acid Sulfate Soils Overlay (refer to Figure 6.6). The Overall Outcomes relevant
to the subject site are as follows:
a) development in areas at risk from natural hazards is compatible with the nature of
the natural hazard;
b) the risk to people, property and the natural environment from natural hazards is
minimised;
c) development does not result in a material increase in the extent or severity of
natural hazards; and
d) for acid sulfate areas-the generation or release of acid and associated metal
contaminants into the environment is avoided
Compliance
Although the proposed facility is located within a Medium Bushfire Hazard area, the
proposed use will not increase the risk or impact of this natural hazard since it is already
cleared of vegetation where the foundations and earthworks are to follow engineering
design standards and will not use equipment that significantly increases the risk of fire. In
addition no buildings are proposed and the proposed development for a
Telecommunication Facility is not considered to be a habitable use and will not result in an
additional increase in the number of people living, working or congregating in the Bushfire
Hazard Area.
The facility is also identified as containing ’High Potential Acid Sulfate Soils’ between 0 m-
5 m AHD. The proposal is for a 30 m monopole to be located at approximately 11 m AHD
natural ground level. The proposed development complies with the overall outcomes of the
Natural Hazards Overlay Code as it is not anticipated to involve excavation of more than
100 m3 or filling of more than 500 m3 nor is excavation expected to be undertaken below 5
m AHD natural ground level. As such, the proposed development will not result in the
disturbance of acid sulfate soils and reflects the State Planning Policy 2/02 Planning and
Managing Development involving Acid Sulfate Soils.
The proposed facility will also be located outside of ’Landslide Hazard Areas’ as identified
on the Natural Hazard: Landslide & Flooding Overlay. Therefore the proposed use will not
increase the risk or impact of this natural hazard as it will be constructed on level land
which does not slope and is not considered to be unstable. Earthworks required to
construct the facility will be minimal and will not result in any adverse impacts on land
,
I stability.
The proposed facility is located within a ’Flood Hazard Area’ and on land ’Subject to
minimum floor height’ as identified on the Natural Hazard: Landslide & Flooding Overlay.
However the proposed telecommunication facility is not for a habitable use and has been
sited and designed with raised equipment cabinets on elevated grillage to minimise the
hazards associated with flooding. The proposed will not result in an increased risk of flood,
bushfire or landslide for the area and reflects the State Planning Policy 1/03 Mitigating the
Impacts of Flood, Bushfire and Landslide.
