Dear Sir/Madam

Information Request
Sustainable Planning Act 2009

I refer to your application and advise that Council requires further information to satisfactorily assess the proposal.
application details
Application No:	MCU17/0028 OPW17/0120 REC17/0012
Proposal:	Development Permit for Material Change of Use of Premises - Multiple housing Type 1 – Duplex Development Permit for Operational Work (Engineering Works) Development Permit to Reconfigure a Lot - 1 Lot into 2 Lots
Street Address:	23 Tewantin Rd COOROY QLD 4563
Real Property Description:	Lot 102 C 5604
information required
The information requested is set out below:

Issue
The proposed access driveway to Tewantin Road is a significant structure in a Main Roads controlled road. The structure has the potential to create adverse impacts on the existing services, vegetation and drainage patterns.

Information required
Provide written approval from the Department of Transport and Main Roads for the proposed access driveway works and associated retaining structures.

Provide comment from the design engineer that addresses the potential impacts on the adjoining property due to the changes in overland flows created by the proposed access driveway.

Provide RPEQ certification that states that:

the designed structure will provide suitable sight lines to pedestrians on the footpath in Tewantin Road.

the proposed retaining structures do not create an unacceptable fall risk in the road reserve or within the property.

Provide written approval from any third party service provider (Telstra, Unitywater etc) whose assets (both above and below ground) may be affected by the works

Issue
The site has a frontage to Olivine Lane and aside from a new stormwater outlet, the applicant is not proposing any new works. This intent does not appear to be in accordance with Specific Outcome O13 of the Transport, Roads and Drainage Code. The proposed stormwater outlet is located within a section of layback kerb and in close proximity to an existing stormwater outlet from the adjoining development.

Information required
Demonstrate how the proposed development achieves Specific Outcome O13 of the Transport, Roads and Drainage Code.

Provide additional detail on the proposed stormwater outlet to Olivine Lane. The detail must include:

Any necessary kerb changes;

The relationship with the existing stormwater outlet from the adjoining development; AND

The discharge rate from the development site. Please note that Council is unlikely to support discharge at any one location that is greater than 25l/sec or has the potential to create a traffic hazard.

Issue
Schedule 1 - Minimum Boundary Setbacks of the Noosa Plan specifies a 6 metre rear setback requirement. The development proposes 2.0 metre setbacks for both the existing and new dwelling. It is noted that the planning report details that a 14 metre rear setback is proposed.

Information required
Demonstrate how the proposed reduced setbacks comply with Specific Outcome O8 of the Cooroy and Lake Macdonald Locality Code.

End of Information Request

Under the provisions of the Sustainable Planning Act 2009, you have three options available in response to this Information Request. You may give the assessment manager (in this instance Council) and each referral agency (if any):

all of the information requested; or
part of the information requested together with a letter asking the assessment manager and each referral agency to proceed with the assessment of the application; or
a letter;
stating that you do not intend to supply any of the information requested; and
asking the assessment manager and each referral agency to proceed with the assessment of the application.

Please be aware that under Section 279 of the Sustainable Planning Act 2009
the applicant must respond to the Information Request within 6 months of the request or otherwise the application lapses.

A response to the above is required to be submitted, prior to further assessment of the application. If any further matters arise as part of assessment of this application, you will be advised accordingly.

Council prefers that all the information requested be submitted as one package. A preliminary assessment only of the application has been undertaken and during the formal decision stage, or as a result of public exhibition, other matters may arise. You are requested to advise your client directly regarding this request.

Should any Concurrence Agency make an Information Request, you are reminded of your obligation to provide Council with a copy of the information provided to that Concurrence Agency.

You may wish to follow the progress of this application online at www.noosa.qld.gov.au . The “PD Online” page can be accessed via "Quick Links" on the left hand side of the screen. A disclaimer will appear; upon clicking “agree”, a search for a development application or property address can be carried out.

Should you have any further queries in relation to the above, please do not hesitate to contact Patrick Murphy on the above number.

Yours faithfully

Patrick Murphy
