Attachment A
Decision Evidence and Findings
Findings on material questions of fact:
The objective of the Transport Infrastructure Act 1994 (TIA) requires the establishment of
a road regime that is safe and efficient.
Section 62 of the TIA provides for the Chief Executive of the Department of Transport
and Main Roads (TMR) to make decisions about permitted road access locations
between particular land and a state-controlled road.
The application is for a material change of use to establish a Detached Dwelling on Lot
3SP100439. The proposed development is adjacent to Boreen Road, road ID: 1412 (a
state-controlled road), locally known as Louis Bazzo Drive.
The development involves an intensification to the use of the access between the state-
controlled road and Lot 3SP100439 and is an application under section 62A of TIA.
Boreen Road is not listed as a limited access road. A new or changed access has been
assessed under the State Development Assessment Provisions (SDAP) version 3.2,
effective 3 February 2025 and TMR's Vehicular access to state-controlled roads policy.
Boreen Road is a rural type standard road with a table drain on either side and a single
lane in either direction with a double centreline. The posted speed limit at the subject site
is 90km/hr.
The annual average daily traffic (AADT) at the subject site is 1253 vehicles (2022) with
609 in the gazettal direction and 644 against the gazettal direction.
Access between Boreen Road and the subject site is required to be upgraded in
accordance with the the Department of Transport and Main Roads Standard Drawing
1807, for a Rural Property Access, Type A, with a throat width of 6m and sealed to the
property boundary.
The proposed development can be effectively implemented without significant impacts to
the safety and operations of the state-controlled road network with the conditioned
requirements.
