114. Applicant's declaration
(8] By making this application, I declare that all information in this application is true and correct (Note: tt is unlawful to
provide false or misleading information)
Notes for completing this form
• Section 261 of the Sustainable Planning Act 2009 prescribes when an application is a properly-made application.
Note, the assessment manager has discretion to accept an application as properly made despite any non-
compliance with the requirement to provide mandatory supporting information under section 260(1 )(c) of the
Sustainable Planning Act 2009
Applicant details
• Where the applicant is not a natural person, ensure the applicant entity is a real legal entity.
Question 1
• Schedule 3 of the Sustainable Planning Regulation 2009 identifies assessable development and the type of
assessment. Where schedule 3 identifies assessable development as "various aspects of development" the
applicant must identify each aspect of the development on Tables A, Band C respectively and as required.
Question 6
• Section 263 of the Sustainable Planning Act 2009 sets out when the consent of the owner of the land is required for
an application. Section 260(1)(e) of the Sustainable Planning Act 2009 provides that if the owner's consent is
required under section 263, then an application must contain, or be accompanied by, the written consent of the
owner, or include a declaration by the applicant that the owner has given written consent to the making of the
application. If a development application relates to a state resource, the application is not required to be supported
by evidence of an allocation or entillementto a state resource. However, where the state is the owner of the
subject land, the written consent of the state, as landowner, may be required. Allocation or entitlement to the state
resource is a separate process and will need to be obtained before development commences.
Question 7
• If the premises is listed on either the Contaminated Land Register (CLR) or the Environmental
Management Register (EMR) under the Environmental Protection Act 1994 it may be necessary to
seek compliance assessment. Schedule 18 of the Sustainable Planning Regulation 2009 identifies
where compliance assessment is required.
Question 11
• The Building and Construction Industry (Portable Long Service Leave) Act 1991 prescribes when the portable long
service leave levy is payable.
• The portable long service leave levy amount and other prescribed percentages and rates for calculating the levy
are prescribed in the Building and Construction Industry (portable Long Service Leave) Regulation 2002.

Question 12
• The portable long service leave levy need not be paid when the application is made, but the Building and
Construction Industry (Portable Long Service Leave) Act 1991 requires the levy to be paid before a development
permit is issued.
• Building and construction industry notification and payment forms are available from any Queensland post office or
agency, on request from QLeave, or can be completed on the QLeave website at www.qleave.qld.gov.au. For
further information contact QLeave on 1800803481 or visit www.qleave.qld.gov.au.

MATERIAL CHANGE OF USE APPLICATION FOR 52 GEVERS ROAD, BLACK MOUNTAIN. IAN & LINDA MCGilLIVRAY. Please find attached plans and site plans for the MCU for the above address. The application is for the building of 2 additional buildings on the above property, a Relatives Dwelling and a Studio/storage building. The MCU relates to our request to have the 2 buildings more than 25 metres from the existing dwelling on the property. The relatives dwelling will be for our 26 year old son to live in. There are a number of site options around the property but for a number of reasons none of these are suitable for this building. The land on the southern side of our house is quite steep and would be difficult to build on and to accessonce the dwelling was built. It would require extensive earthworks to create level areas for the entrance to the building and to create car parking space underneath. The area to the Southwest is flood prone as it is in the overflow area of the dam above it. Directly to the west of our house is a main accesstrack to the shed and the back of the property so it is not possible to build here either. To the north and North West of the house there are a number of Swamp Gum Eucalypts, otherwise known as "Widow Makers". In the 8 years that we have lived here they have dropped many large branches with no warning at all. Some of these branches we have estimated at well over one tonne each and would present a serious safety hazard to any building and its occupants built near them. For these reasons we have chosen the site next to the driveway as marked for the studio and storage room. It would have easy access, would be aesthetically pleasing from the road with some minor planting around it but would still be within easy reach for regular use. It is 50 metres from the front boundary, 13 metres from the side boundary and SO metres from the existing house. The Relatives Dwelling we wish to locate next to a previously levelled track above the house as marked on the site plan. We think this building as shown would be an environmentally responsible building as it would be built from 2 recycled shipping containers with a deck between them. The deck would be no more than the mandatory 3 metres in width from each container being just on 6 metres wide at its widest point. There is already a track to the site from the Southern side and we would only have to do minor track building to access it from the West. Only minimal earthworks would be required to create a parking space underneath and none for the building itself. We will also be making this building wheelchair accessible as it is all on one level and has ramp accessat the front and a parking
Page 18
space next to the ramp. This will make it very easy for my aged mother to move into in the future if my son moves out. It will be 200 metres from the front boundary, 100 metres from the rear, 13 metres from the side and 55 metres from the existing house. We also regard this location as having the best views from the property as it looks out to the Kenilworth Rangesto the West and the building has been designed to make the most of these views. The building will be sympathetic to the natural character of the block and will not be easily visible from the road due to the location behind the existing house.
