AND UPON THE COURT BEING SATISFIED THAT the change to the development application depicted in the affidavits of Christopher Buckley filed 24 July 2024 and Christopher Camp filed 15 August 2024 is a minor change as that term is defined in the Planning Act 2016;

IT IS ADJUDGED WITH THE CONSENT OF THE PARTIES THAT:
The appeal be allowed.
The Respondent’s decision to refuse the development application be set aside.
The development application be approved subject to the conditions, plans and documents attached hereto and marked “Attachment A”, contained at pages 1 to 91.
Each party bear its own costs.
