response to information request dowd
15 July 2021 Patrick Murphy Noosa Council [email protected] RE: Response to Information Request (MCU17/0046.03) situated at 2/38 Park Cres, Sunshine Beach Council issued a further information request on 5 July 2021. The applicant provides the following additional information in response to the items: 1. Demonstrate: a. The need for short term accommodation. b. That an adequate supply of permanent residential dwellings is retained. The Coastal Communities code seeks for development in the Medium Density Housing Zone accommodates a greater diversity in housing types, while also having a comparatively higher proportion of multi-unit accommodation for both visitors and residents. The relevant Performance Outcomes PO15 seeks for Visitor accommodation is not be located in areas which are predominantly permanent residential. The drafting of the planning scheme is grammatically incorrect, however it appears the scheme intent is seeking for the ‘clustering’ of visitor accommodation away from permanent residential uses in close proximity to key tourist areas. Sunshine Beach village is considered a key tourist area of Noosa Shire. Visitor accommodation is identified as a CONSISTENT use in the Medium Density Housing zone and there is no expectation to demonstrate Planning or Economic Need for a consistent development application. The relevant Overall Outcomes and Purpose statements require appropriate management of visitor accommodation, so as not to reduce the amenity of the surrounding permanent residents and retain an adequate supply of housing in the local plan area. A copy of the relevant extracts of the Coastal Communities Local Plan are included below. The subject property was recently purchased by the applicant for $5.1 million which includes good views to Sunshine Beach, level walking access to the Village and beach within a sperate building.

Many of the units within the Medium-Density and High-Density Housing zones of Sunshine
Beach include buildings constructed pre 2006, allowing for use as both short and long-
term accommodation. This application seeks a similar use of the unit for both short and
long-term accommodation.
The proposal is within a ‘cluster’ of visitor accommodation units away from permanent
residential uses (such as Sunrise Beach and properties west of David Low Way) and is in
close proximity to the key tourist area of Sunshine Beach village. The development meets
the Overall Outcomes providing multi-unit accommodation for both visitors and residents,
consistent with the surrounding neighbourhood. Appropriate conditions can be provided
to allow manage the visitor accommodation use including restrictions on numbers, beds,
carparking, waste management, code of conduct and complaints management.
Pursuant to the Development Assessment Rules, the applicant has given the assessment
manager the information requested. Please provide adjoining owners details for public
notification of the application at your earliest convenience.
