RECOMMENDATION
That Council note the report by the Property Officer to the Services & Organisation Committee
Meeting dated 9 August 2016 and approve the proposed transfer of the lease for Sunrise
Neighbourhood Shopping Centre, Shop 4 – Dentist, from Tom Wilkinson Dental Pty Ltd to
Sunrise Dental Care Pty Ltd.


REPORT
Tom Wilkinson Dental Pty Ltd (the Lessee) has held the lease for Shop 4 Sunrise Neighbourhood
Shopping Centre since 1 July 2005. The current 5-year lease expires in June 2020, with a further
5 year option available.
The Lessee has a contract of sale for the business. The sale is conditional on the lease
transferring to the proposed new business owner.
Accordingly, the purpose of this report is to seek Council approval to transfer the Shop 4 lease to
Sunrise Dental Care Pty Ltd. The proposed new business owner will continue to provide dental
services from the premises.
The proposed new business owner has provided Council with documentation to support the
lease transfer request including references and financial information to allow an evaluation of
their suitability to enter into the lease. The documentation has been assessed and the proposed
new business owner is deemed suitable to acquire the lease.
Subsequent to formal Council resolution a deed of assignment is to be executed by the current
lessee, the proposed new business owner and Council.

B.    Approve the new lease agreement to Tom Wilkinson Dental Pty Ltd for Shop 4,
      Sunrise Neighbourhood Shopping Centre for 5 years commencing 1 July 2015 (with a
      5 year option); and

D.    Apply the exception to the requirement for tendering of these leases under section
      236 (1) (c) (iii) of the Local Government Regulation 2012 as the lease renewals are to
      existing tenants.
