Further to the application lodged last Friday please find below advice from JHK legal regarding the proposed parking spaces and changes to the easement terms. The intent is that the parking spaces would be available to all the lots serviced by the access easement. Our client will own all 4 lots from mid January so this will be a simple exercise. I trust this addresses your concerns on this matter.

I would then suggest that the easements be amended to refer to the new parking areas and gate.  Repair and maintenance and costs splits for that would be dealt with in those amendments.  All of that can be done fairly simply but would need to be finalised before Lot 16 is sold or the sale contract for that lot contemplate those amendments being completed before settlement.

By the looks of the plan there is to be no change to the easement areas just that certain parts will be able to be used for car parking.  That can be accommodated by amendments to the terms of the existing easements.  Additional terms could be added regarding any proposed access gate.
